Summary

The bill supplements § 58, point 14 of the Penal Code (KarS), which stipulates the punishment as an aggravating circumstance for the commission of an offense against a person due to his nationality, race, skin color, gender, disability, language, origin, religion, sexual orientation, political beliefs or property or social status. § 151 of the Criminal Code (incitement to hatred) is also amended, which stipulates that public incitement to hatred is punishable as a crime, to violence or discrimination against a group of persons or a member of a group on the basis of nationality, race, skin color, gender, disability, language, origin, religion, sexual orientation, political beliefs or property or social status in a way that gives grounds to fear an act of violence following the incitement or a significant threat to the safety of society. The purpose of the bill is also to bring Estonian criminal law into line with the law of the European Union (primarily with the 2008 Framework Decision No. 2008/913/JSK, the deadline for transposition was in 2010) and other international obligations in terms of punishing crimes committed with a motive for enmity and incitement to enmity.
