Summary
Eelnõu eesmärk on vabastada koduomanikud omavalitsustele kuuluvate kõnniteede koristamise kohustusest ja tagada seeläbi ka omavalitsustele kuuluvate kõnniteede õigeaegne ja parema kvaliteediga koristamine. Eelnõuga soovitakse tagada nende kõnniteede koristamine omavalitsuste poolt. Praegu kehtiva ehitusseadustiku paragrahvi 97 lõige 6 kohaselt on teega külgneva maatüki omanik kohustatud linnas, alevis ja alevikus korraldama sõidutee ja tema kinnisasja vahel asuva kõnnitee koristuse, sealhulgas lume ja libeduse tõrje tasemel, mis võimaldab kõnniteel ohutult liigelda. Tegemist on seadusega koduomanikele pandud kohustusega, mida ei hüvitata. Kõnniteede korrashoid on avalikes huvides, et kõigil oleks turvaline seal liikuda. Kõnniteede korrashoiu kohustuse panemine koduomanikele on ebaõiglane ja paljudel juhtudel teostamatu ülesanne. Kohaliku omavalitsuse korralduse seaduse paragrahvi 6 lõike 1 kohaselt on kohaliku omavalitsuse ülesandeks korraldada oma teede ja tänavate korrashoidu. Teeseaduse paragrahvi 2 lõike 2 punkti 1 kohaselt hõlmab tee mõiste ka kõnniteed.
