Summary
Eelnõuga viiakse kollektiivlepingu tingimuse laiendamise regulatsiooni vastavusse põhiseaduse kaitse all oleva ettevõtlusvabadusega, tagades samas sotsiaalpartnerluse ja kollektiivse kaasamise võimekus. Laiendamise regulatsioon puudutab kollektiivlepinguid, mis on sõlmitud tööandjate ja ametiühingute liitude või keskliitude vahel. Eesmärk on, et palga-, töö- ja puhkeaja tingimusi saaks kogu sektorile laiendada vaid juhul, kui selles on kokku leppinud tööandjad, kes pakuvad tööd vähemalt 40 protsendile vastava tegevusala töötajatele ja ametiühingute liit või sama tegevusala liikmeid koondav ametiühing, kelle liikmed moodustavad 15 protsenti tegevusala töötajatest või kellel on vähemalt 500 liiget. Enne kokkuleppe sõlmimist on kohustus avalikult informeerida ning kaasata kõiki töötajaid ja tööandjaid, kelle suhtes tingimusi laiendada soovitakse. Kehtiva korra peamiseks probleemiks on laiendamise eeltingimuste ja kohaldamiskriteeriumite puudumine, millest tulenevalt on võimalik väikesel grupil kokku leppida kohustuste laiendamises kogu sektorile. Sellega kaasneb ebaproportsionaalne piirang ettevõtlusvabadusele. Eelnõuga muudetakse ka ametiühingute seadust ja töötajate usaldusisiku seadust, täpsustatakse tööandja kohustust anda tööajast vaba aega usaldusisiku tegevusega seotud ülesannete täitmiseks ka siis kui usaldusisikuid on rohkem kui üks. Lisaks muudetakse töölepingu seadust, suurendatakse töösuhte ülesütlemise tühisuse korral makstavat hüvitist olukorras, kus töösuhe on ilma seadusest tuleneva aluseta üles öeldud raseda, rasedus- või sünnituspuhkuse õigusega või töötajate esindajast töötajaga. Samuti muudetakse avaliku teenistuse seadust, suurendatakse teenistussuhte ülesütlemise tühisuse korral makstavat hüvitis olukorras, mil teenistussuhe öeldakse ilma seadusest tuleneva aluseta üles raseda, rasedus- või sünnituspuhkuse õigusega, alla seitsmeaastast last kasvatava või ametnike esindajast ametnikuga. Veel tehakse tehnilisi muudatusi nii kollektiivlepingu seaduses kui Eestisse lähetatud töötajate töötingimuste seaduses, millega ei kaasne muudatusi senises praktikas. Eelnõu teise lugemisega lisandusid tööturuteenuste- ja toetuste seaduse ja töötuskindlustuse seaduse ajutised muudatused, mille eesmärk on abistada registreeritud töötuid, makstes täiendavat ühekordset töötutoetust või töötuskindlustushüvitist 60 päeva, kui töötutoetuse maksmise ajavahemiku või töötuskindlustushüvitise perioodi lõppemise kuul on täidetud järgmised tingimused: 1) registreeritud töötuse määr üle-eelmisel kalendrikuul oli kõrgem kui 8,5%; 2) töötuskindlustushüvitise periood lõpeb ajavahemikul 2021. aasta 1. september kuni 2022. aasta 28. veebruar.
