Summary
Eelnõuga võetakse Eesti õigusesse üle ELi direktiiv, mille eesmärk on luua terves Euroopa Liidus toimiv konkurentsijärelevalve. Konkurentsijärelevalvemenetlus aitab luua ja säilitada vaba turgu, mis soodustab innovatsiooni ja muudab ettevõtjad välisturgudel konkurentsivõimelisemaks. Konkurentsiseaduse muutmise eesmärk on tugevdada konkurentsijärelevalvet, et tagada tarbijatele õiglasem hind, kvaliteetsem ja laiem kaubavalik. Konkurentsijärelevalve toimuks kõigis liikmesriikides ühtedel alustel ja sarnaste uurimismeetoditega, mis suurendab valdkonna läbipaistvust ja kasvatab võimekust menetleda ka liikmesriikide üleseid rikkumisi. Eelnõu aluseks oleva ELi direktiivi ülevõtmistähtaeg oli 4. veebruar 2021. Praeguseks on Euroopa Komisjon esitanud Euroopa Kohtule Eesti vastu hagi seoses direktiivi mitteülevõtmisega. Seaduse muutmise olulisim osa on konkurentsijärelevalvemenetluse tervikregulatsiooni kehtestamine. Konkurentsijärelevalvemenetluse läbiviijaks saab konkurentsiamet. Uus menetlus aitab konkurentsiametil paremini järelevalvet teha, sest selle uurimismeetmed on välja töötatud spetsiifiliselt konkurentsiõiguse rikkumise uurimiseks. Konkurentsiõiguse rikkumise tuvastamisel võib selle toime pannud ettevõtjale või ettevõtjate ühendusele olla määratud trahv kuni 10 protsenti ettevõtja või ettevõtjate ühenduse üleilmsest kogukäibest trahvi kohaldamisele eelnenud majandusaastal. Kriminaalmenetlusele omaseid menetlustoiminguid nagu jälitustoiming ja kinnipidamine konkurentsijärelevalvemenetluses kasutada ei saa.
