Summary

With the bill, the EU directive is adopted into Estonian law, the purpose of which is to create competition supervision that functions throughout the European Union. The competition supervision procedure helps to create and maintain a free market, which encourages innovation and makes companies more competitive in foreign markets. The purpose of amending the Competition Act is to strengthen competition supervision in order to ensure a fairer price, higher quality and wider merchandise selection. Competition supervision would be carried out in all member states on the same basis and with similar investigation methods, which would increase the transparency of the field and increase the ability to process violations across member states as well. The deadline for the transposition of the EU directive, which is the basis of the bill, was February 4, 2021. To date, the European Commission has filed a lawsuit against Estonia in the European Court of Justice regarding the non-transposition of the directive. The Competition Authority will be the executor of the competition supervision procedure. The new procedure will help the Competition Authority to perform better supervision, as its investigative measures have been developed specifically to investigate competition law violations. If a violation of competition law is detected, the company or association of companies that committed it may be fined up to 10 percent of the company or from the global total turnover of the association of entrepreneurs in the financial year preceding the application of the fine. Procedural actions typical of criminal proceedings, such as surveillance and detention, cannot be used in competition supervision proceedings.
