Summary
Eelnõu kohaselt see kaasajastatakse ja täpsustatakse ametiisikute toimingupiirangu rikkumisega seonduvat regulatsiooni, eelkõige muutub selgemaks ametiisikuga seotud isikute loetelu. Seotud isikuteks on edaspidi ametiisiku lähedased isikud. Lisaks sugulus-ja põlvnevussuhtele tuleb lähedussuhte sisustamisel arvestada tegelikku sotsiaalset ja emotsionaalset sidet inimeste vahel, näiteks vastutuse jagamist, üksteisele toetumist, usaldust. Nende inimeste suhtes otsuste ja toimingute tegemine on keelatud ning kohaldub toimingupiirang. Täpsustakse, et kui ametiisik on seotud isik sellises juriidilises isikus, kuhu ta on määratud tööalaselt, siis ei tohi ta teha toiminguid ja otsuseid iseenda kui füüsilise isiku suhtes, näiteks enda töötasu ja hüvitiste küsimuses. Samuti ei pea tervishoiutöötaja edaspidi kohaldama seotud isiku suhtes toimingupiirangut juhul, kui tervishoiuteenuse osutamine ei loo temale või temaga seotud isikule olulist põhjendamatut eelist. Lisaks näeb seaduse huvide deklaratsiooni esitajale ette kohustuse deklareerida investeeringud krüptovarasse ning osalused ühisrahastusprojektides ja nõuded ühisrahastuse projektide vastu. Krüptovara puhul tuleb deklaratsioonis märkida selle liik ja väärtus, ühisrahastusprojekti investeeringu või nõude puhul ühisrahastu teenuseosutaja ning osaluse väärtus. Samuti lisandub huvide deklareerijale kohustus kanda deklaratsiooni andmed selle kohta, kui ta on tegelik kasusaaja rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses.
