Summary
Eelnõuga lisatakse kodakondsuse seadusesse säte, mille heakskiitmisel saab lugeda Eesti kodakondsuse saamise eelduseks oleva eesti keele oskuse nõude täidetuks, kui isik on omandanud eesti keeles põhi-, kesk- või kõrghariduse või sooritanud põhikoolis või gümnaasiumis nõutava tulemusega eesti keele kui teise keele riikliku eksami. Samuti nähakse seaduses ettevõimalus lugeda Eesti kodakondsuse saamise eelduseks olev Eesti Vabariigi põhiseaduse ja kodakondsuse seaduse tundmise nõue täidetuks, kui isik on edukalt sooritanud põhikoolis riikliku testi, millega hinnatakse Eesti Vabariigi põhiseaduse, riigikorra ja ühiskonna toimimise põhialuste ning kodaniku õiguste ja kohustuste tundmist. Muudatuste eesmärk on reguleerida seaduses üldised tingimused kodakondsuse taotlemiseks tehtavate testide ja põhikooli lõpus sooritatavate testide ühitamiseks. Veel on ettepanek muuta põhikooli- ja gümnaasiumiseaduses tervikuna põhikooli lõpetamise, eksami- ja eksamitulemuste vaidlustamise ning õpitulemuste välishindamisega seonduvad sätted ning kehtestada need uues sõnastuses. See tähendab, et eelnõu jõustumise korral ei ole enam põhikooli lõpueksamite sooritamine põhikooli lõpetamise tingimuseks. Koolidele antakse õigus ise otsustada selle üle, kas õpilane on põhiharidust omandanud, ning kehtestada kooli lõpetamise tingimusena omapoolne nõue – kooli spetsiifikale vastav koolieksam, loov- või uurimustöö. Kõigile põhikooli lõpuklassi õpilastele viiakse eelnõu kohaselt läbi eesti keele ja eesti keele kui teise keele eksam, mille sooritamine ei ole seotud põhikooli lõpetamisega, kuid mille eesmärk on mõõta põhihariduse omandanud inimese eesti keele oskuse taset. Lisaks tehakse muudatusi õpitulemuste välishindamises. Muudatuste eesmärk on tagada õpilastele, lapsevanemale, koolile, kooli pidajale ja riigile võimalikult objektiivne ja võrreldav tagasiside riiklikes õppekavades sätestatud õpitulemuste kohta. Uue välishindamise instrumendina nähakse seaduses õpilaste, lapsevanemate ja koolitöötajate riiklikud küsitlused, mille tulemused aitavad luua vajalikku konteksti õpilaste eksami või riikliku testide tulemuste tõlgendamiseks ja selgitamiseks.
