Summary
Eelnõuga suurendatakse kohtumenetluse avalikkust ja kohtupraktika kättesaadavust, tagades samal ajal süütuse presumptsioon ja juurdepääsupiiranguga andmete, aga ka füüsilisest isikust menetlusosalise eriliiki isikuandmete ja eraelu puutumatuse kaitse. Edaspidi avalikustatakse Riigi Teatajas avalikult teatavaks tehtud kohtuotsused kohe märkega „jõustumata“. Kui lahend jõustub või tühistatakse, muutub vastav märge automaatselt. Praegu on tagatud avalikkuse juurdepääs vaid jõustunud kohtulahenditele, tühistatud ja jõustumata kohtulahenditele juurde ei pääse. Tsiviilkohtu- ja kriminaalmenetluse seadustikes täiendatakse arvutivõrgus avalikustamisele kuuluvate määruste loetelu. Avalikustamisele kuuluvad ka tingimisi enne tähtaega vangistusest vabastamise, korteri- ja kaasomandi asjades ning avalikult kasutatavale teele juurdepääsu, maaparandussüsteemi eesvoolu ja tehnorajatise talumise asjades tehtud määrused. Lisaks ringkonnakohtu ja Riigikohtu hagita menetlust lõpetavatele määrustele tuleb avalikustada ka samas asjas tehtud maakohtu lahend. Lisaks saavad menetlusvälised isikud taotleda kohtutoimikuga tutvumist tsiviil- ja halduskohtumenetluses kinnises menetluses arutatud kohtuasjas ning kriminaalmenetluses lõpetatud kohtuasjas. Edaspidi eeldatakse ajakirjanduslikul eesmärgil toimikuga tutvumise puhul õigustatud huvi, kuid kohus võib nõuda huvi põhjendamist. Õigusemõistmise huvides võib kohtu algatusel teha kohtuistungist ülekande veebilehel. Info ülekande toimumise kohta avalikustatakse Riigi Teataja veebilehel. Kriminaalmenetluse seadustikku täiendatakse kaebeõiguse võimaldamisega isikule, kellele kohus on määranud istungil teatavaks saanud asjaolude saladuses hoidmise kohustuse.
