Summary
Eelnõuga suurendatakse kohalike omavalitsuste enesekorraldusõigust, jättes detailsed KOV sisemised protseduurid omavalitsuste enda otsustada. Samuti laiendatakse võimalusi elanike kaasamiseks nähes ette kohaliku rahvaküsitluse. Seni oli vaid õigusaktide algatamise õigus. Seadusesse lisatakse võimalus luua ka piirkondlikke esinduskogusid, näiteks kogukonnakogu. Eelnõu järgi nähakse uudsena ette võimalus anda KOVile seadusega või selle alusel pandud kohaliku ülesande täitmine halduslepinguga üle teisele KOVile, mis praegu toimub valdavalt eraõiguslike juriidiliste isikute kaudu. Eelnõu järgi tehakse muudatusi KOV volikogu ja valitsuse töö korraldamisel, näiteks valla- ja linnasekretärid vabanevad kohustusest juhtida kantseleid, istungite läbiviimiseks lisatakse selgesõnaline võimalus kasutada elektroonilisi vahendeid. KOVi volikogu pädevuse ja liikmete osas nähakse ette, et KOV ametnik ei saa olla KOV volikogu liige ja tema ametikohustuste täitmise ajaks volikogu liikme volitused peatatakse. Ka KOVi hallatavate asutuste juhid ei saa samal ajal enam olla volikogu liikmed. Lisaks esimehele võimaldatakse ka aseesimehe koht KOVi volikogu otsusel muuta palgaliseks, vähendatakse koosseisu häälteenamust nõudvaid küsimusi, näiteks esindajate nimetamine KOVi liidu üldkoosolekule, valla- või linnasekretäril on õigus istungitel sõnaõigusega osa võtta ja täpsustatakse volikogu liikme õigust saada teavet. Eelnõu järgi võimaldatakse KOVi volikogu määrusega seada minimaalseid põhiõiguste piiranguid, kui need on põhjendatud. Seaduse muutmisega täpsustakse norme, mis on praktikas tekitanud tõlgendusraskusi, arvestatakse kohtulahendeid, samuti vähendatakse regulatsioonide mahtu. Kohalike omavalitsuste olemust, ülesandeid, rahastamist ja järelevalvet ei muudeta.
