Summary
Eelnõuga reformitakse esimese ja teise astme kohtute halduskorraldust selgemaks, tõhusamaks ja et see oleks autonoomne. Praegu on kohtuhaldus killustatud – sellega tegelevad mitmed osapooled, nagu justiits- ja digiministeerium, kohtute haldamise nõukoda, kohtute esimehed, kohtudirektorid ning teatud osas ka Riigikohus. Selline hajutatud vastutus killustab süsteemi ja muudab selle raskesti juhitavaks. Uue seaduse järgi antakse suurem osa kohtuhaldusülesannetest justiitsministeeriumilt üle kohtutele endile. Senise kohtute haldamise nõukoja asemele luuakse uus struktuur – kohtute haldus- ja arendusnõukogu (KHAN). Kui senine organ oli pigem nõuandev ja kooskõlastav, siis KHAN hakkab olema kohtuhalduse kõrgeim otsustuskogu. See nõukogu suunab kohtute arendamist ja korraldab strateegilisel tasandil haldusotsuseid. Sellega kasvab oluliselt kohtunike otsustusõigus mitte ainult tugiteenuste, vaid ka kohtute arengusuuna üle. Lisaks moodustatakse kohtuhaldusteenistus (KHT), mis hakkab pakkuma kohtutele igapäevaseid tugiteenuseid, nagu tõlkimine, arhiveerimine ning finants- ja varahaldus. KHT võtab üle senised ministeeriumi kohtuhaldusülesanded ning kohtudirektorite ülesanded. KHT-d juhib viieks aastaks ametisse määratud direktor, kelle tegevust kontrollib kohtute haldus- ja arendusnõukogu.
