Summary
Eelnõuga luuakse haldusmenetluse seaduses alused automaatse haldusmenetluse läbiviimiseks, samuti automaatse haldusakti andmiseks või toimingu sooritamiseks, mis tähendab haldusorgani nimel tegutseva ametniku või töötaja sekkumiseta tegevust. Seda siis, kui riivatakse õiguseid või vabadusi, mil on vaja seaduslikku alust. Seega on automaatse haldusmenetluse regulatsioon eelnõu järgi aluseks halduse tegevustele, millega kaasneb isikute õiguste ja vabaduste riive ning on vaja töödelda isikuandmeid. Automaatse haldusmenetluse või haldusakti andmise võib algatada nii haldusorgan kui ka toetust, teenust või hüvitist sooviv isik oma taotlusega, näiteks iseteenindusportaalis ja selleks peavad valdkonnaseadustes sisalduma vastavad normid. Eelnõu kohaselt tuleb haldusorganil automaatse haldusmenetluse läbiviimiseks arvesse võtta nii inimese kui ka avalikku huvi, otsustamise aluseks olevas õigusnormis sisalduvat kaalutlusõigust, samuti määratlemata õigusmõistet, otsustamiseks vajaminevaid andmeid on piisavalt, isikut ei ole vaja ära kuulata ning kahjustada ei tohi kolmandate ja huvitatud isikute õigusi ja huve. Kui valdkonnaseaduses sisaldub kaalutlusõigus või määratlemata õigusmõiste, kuid ratsionaalne on kasutada automaatset menetlust, siis eelnõu kohaselt koostab haldusorgan ühetaoliseks kohaldamiseks haldusesisese halduseeskirja tüüpjuhtudest. Eelnõuga nähakse ette kasutada automaatseid dialoogisüsteeme, näiteks vestlusroboteid ja virtuaalseid assistente. Lisaks saab haldusorgan seaduses sätestatud juhtudel õiguse rakendada füüsilise või juriidilise isiku osas profiilianalüüsi, mis on seotud ja saab kasutada isikuga seotud aspektide hindamiseks. Eelnõuga täpsustatakse tööturuteenuste ja -toetuste seaduses, töötuskindlustuse seaduses ja töövõimetoetuse seaduses automaatsete haldusaktide andmise põhimõtteid.
