Summary
Eelnõuga laiendatakse osalusvõimalusi Kaitseväe tegevuses, et kaasata senisest enam reservväelasi, ajateenijaid ning Kaitseväes töötavaid tsiviilisikuid. Selleks muudetakse mitut seadust, sealhulgas kaitseväeteenistuse seadust ja kaitseväe korralduse seadust. Muudatustega soovitakse suurendada paindlikkust ja tõhusust personali kaasamisel ilma vajaduseta suurendada tegevväelaste hulka rahuaja ametikohtadel. Eelnõuga luuakse uus teenistusliik – vabatahtlik teenistus –, mis võimaldab reservväelastel ajutiselt osaleda kaitseväe ülesannete täitmises koosseisuvälisel ametikohal. See hõlmab näiteks instruktoritena ajateenijate väljaõpet, alalise valmiduse üksuste mehitamist või osalemist rahvusvahelistel sõjalistel operatsioonidel (RSO-del). Eelnõu kohaselt laiendatakse ajateenijate võimalusi panustada Kaitseväe ülesannetesse, võimaldades neil pärast teatud väljaõppe läbimist osaleda rahvusvahelistel mereväe operatsioonidel. Ajateenija peab andma selleks kirjaliku nõusoleku. Seadust muudetakse, et mereväes, kus ajateenijad moodustavad märkimisväärse osa meeskonnast, oleks võimalik saada praktilist kogemust NATO miinitõrjegruppides, mis on väljaõppe seisukohalt väga väärtuslik. Muudusettepanek tuleneb rangelt mereväe vajadusest ja ajateenijate osalemine muudel rahvusvahelistel missioonidel on välistatud. Eestis on kolmandik mereväe laevade meeskonnast ajateenijad. Eesti osaleb juba rohkem kui 20 aastat NATO alalise miinitõrje grupis, kus ka ajateenijad saavad mere- ja laevapraktikad. NATO on aga otsustanud liita need miinitõrjelaevad oma kiirreageerimisüksuse koosseisu, mistõttu formaalselt osalevad need laevad rahvusvahelisel sõjalisel operatsioonil. Kuna kehtiva seaduse järgi ei saa ajateenijad sõjalistel operatsioonidel osaleda, on tekkinud olukord, kus ajateenijate laevapraktika jääb miinitõrje grupi laevadel väheseks. Eelnõuga antakse võimalus Kaitseväes töötavatele tsiviilisikutele ja avalikus teenistuses olevatele töötajatele osaleda sõjaväelistel õppustel ja läbida vajalik väljaõpe. See aitab vähendada vajadust tegevväelaste järele rahuajal ja võimaldab paremini kasutada olemasolevaid ressursse.
