Summary
Eelnõu seab riigisaladuse ja salastatud välisteabe seaduses ühtse struktuuri teabe kaitset korraldavate ametkondade reeglites. Luuakse normid, mille kohaselt sõnastatakse esmalt pädevused, seejärel neist tulenevad ülesanded ning lõpuks ülesannete täitmisel tehtavad tegevused. Muudatus puudutab Kaitsepolitseiametit, Kaitseväe põhimääruses määratud struktuuriüksust, Välisluureametit ja riigi julgeoleku volitatud esindajat. Riigi julgeoleku volitatud esindajatele seatud norme täiendatakse, et esindajal oleks lisaks salastatud välisteabe kaitse korraldamisele ja kontrollimisele ka riigisaladuse kaitse korraldamise ja kontrollimise roll. Seda juhul, kui riigisaladust avaldatakse välisriigile, rahvusvahelisele organisatsioonile või rahvusvahelise kokkuleppega loodud institutsioonile. Eelnõus käsitletakse ka ametikohti, kuhu tööle asumisega tekib ilma eraldi vormistamise vajaduseta ametikohajärgne juurdepääsu õigus salastatud välisteabele. Muudatusega luuakse õiguslik alus keelduda salastatud välisteabe juurdepääsu andmisest, kui isik ei nõustu antud teabe kaitse nõuete tutvustamise või kinnituse allkirjastamisega. See tähendab, et kui välislepingu kohaselt on teabe kaitse nõuetega tutvumine ja allkirjastatud kinnituse esitamine kohustuslik, kuid isik sellest keeldub, siis tulenevalt eelnõu muudatusest ei ole võimalik talle konkreetsele teabele juurdepääsu anda vaatamata ametikohajärgse juurdepääsuõiguse olemasolule. Eelnõuga tunnistatakse kehtetuks seaduse säte, mille kohaselt peab riigisaladuse välisriigile, rahvusvahelisele organisatsioonile või rahvusvahelise kokkuleppega loodud institutsioonile edastamise iga kord riigi julgeoleku volitatud esindaja juures registreerima.
