Summary

The bill strengthens the protection of consumers' interests in e-commerce and improves cooperation between agencies in the detection and resolution of cross-border violations. The bill makes additions necessary for the implementation of the new directly applicable EU regulation on ensuring compliance with consumer protection legislation and cooperation between agencies (the so-called CPC regulation). In addition, the procedure of the Consumer Disputes Commission will be made more flexible. by CPC regulation Member States are directed to ensure that supervisory authorities have sufficient powers to enable effective supervision in the digital environment. Therefore, the Consumer Protection and Technical Supervision Agency (TTJA) is given additional rights when performing supervision in the digital environment - the right to receive information from any person (including credit institutions), upon identification of the person responsible in the transaction. The TTJA is also given the right to prevent consumer rights in extreme cases to ensure access to the web interface (e.g. e-shop, mobile application). The use of rights must be justified and proportionate, taking into account the nature of the violation and the size and nature of the possible damage. In order to implement the regulation, sanctions in the areas covered by the CPC regulation will be supplemented and harmonized. Changes will be made to the procedure of the Consumer Disputes Commission in order to improve and simplify the out-of-court settlement of consumer disputes. For example it is possible to settle disputes in a one-member committee and with the consent of the applicant in a written procedure without a hearing.
