Summary
Eelnõuga tugevdatakse tarbijate huvide kaitset e-kaubanduses ja parandatakse asutuste vahelist koostööd piiriüleste rikkumiste avastamisel ja lahendamisel. Eelnõuga tehakse täiendused, mis on vajalikud uue tarbijakaitsealaste õigusaktide täitmise tagamist ja asutuste vahelist koostööd käsitleva EL-i otsekohalduva määruse (nn CPC määrus) rakendamiseks. Lisaks muudetakse tarbijavaidluste komisjoni menetluskorda paindlikumaks. CPC määrusega suunatakse liikmesriike tagama järelevalveasutustele piisavaid volitusi, mis võimaldavad teha tõhusat järelevalvet digitaalses keskkonnas. Seetõttu antakse Tarbijakaitse ja Tehnilise Järelevalve Ametile (TTJA) täiendavad õigused järelevalve tegemisel digitaalses keskkonnas – õigus saada teavet igalt isikult (sh krediidiasutustelt), tehingus vastutava isiku tuvastamisel. Samuti antakse TTJA-le õigus äärmuslikul juhul takistada tarbijate õiguste tagamiseks juurdepääsu veebiliidesele (nt e-poele, mobiilirakendusele). Õiguste kasutamine peab olema põhjendatud ja proportsionaalne, arvestades rikkumise laadi ning võimaliku kahju suurust ja olemust. Määruse rakendamiseks täiendatakse ja ühtlustatakse CPC määrusega hõlmatud valdkondades sanktsioone. Tarbijavaidluste komisjoni menetluses tehakse muudatused, et tõhustada ja lihtsustada tarbijavaidluste kohtuvälist lahendamist. Näiteks võimaldatakse vaidluste lahendamist üheliikmelises komisjonis ja kaebaja nõusolekul kirjalikus menetluses ilma istungita.
