Summary
The bill ratifies the International Convention on the Removal of Shipwrecks adopted in Nairobi on May 18, 2007. The convention establishes uniform international rules for the removal of dangerous shipwrecks and compensation for the associated costs. For ship owners who have a ship with a gross tonnage of 300 and more, the requirement of compulsory insurance applies, which covers the costs of removing dangerous shipwrecks. The Convention does not apply retrospectively. Estonia's wish is to apply the convention to all sea areas, not only in the exclusive economic zone, and as a result, an appropriate declaration will be made in accordance with the draft law. Shipowners are obliged to insure the ship to cover damages related to shipwreck to the extent of the liability insurance established by the convention, which depends on the ship's capacity. The ratification of the convention has a positive impact on environmental protection and human health, as it allows for a more efficient response in the event of an accident and possible pollution to prevent the spread. To date, 40 countries have ratified or acceded to the convention, 13 of which are European Union countries. Estonia has signed the convention on March 28, 2008. The convention enters into force for Estonia three months after the day when the instrument of ratification is deposited with the Secretary General of the International Maritime Organization (IMO). In order to comply with the Convention, it is necessary to amend the Maritime Safety Act, the bill for the amendment of which is being approved. According to the changes, the Waterways Agency will start issuing certificates according to the convention, which will lead to some increase in their workload.
