Summary
Eelnõuga ratifitseeritakse 2007. aasta 18. mail Nairobis vastu võetud rahvusvaheline laevavrakkide eemaldamise konventsioon. Konventsioon kehtestab ühtsed rahvusvahelised reeglid ohtlike laevavrakkide eemaldamiseks ja sellega kaasnevate kulude hüvitamiseks. Laevaomanikele, kellel on laev kogumahutavusega 300 ja enam, rakendub kohustusliku kindlustuse nõue, millega on tagatud ohtlike laevavrakkide eemaldamise kulud. Konventsioon ei kohaldu tagasiulatuvalt. Eesti soov on kohaldada konventsiooni kõikidel merealadel, mitte ainult majandusvööndis ning sellest tulenevalt tehakse seaduseelnõu kohaselt asjakohane deklaratsioon. Konventsiooni mõju avaldub ettevõtlusele ja ettevõtluskeskkonnale. See suurendab ettevõtjate kindlustunnet, et Eestis kui mereriigis kohaldatakse ühtseid standardeid. Eelnõu sihtgrupp on Eestis registreeritud laevade omanikud ja prahilepingu alusel Eesti lipu all sõitvad laevad, samuti Eesti mereala külastavate teiste riikide lipu all sõitvate laevade omanikud. Laevaomanikel on kohustus kindlustada laev laeva vrakistumisega seotud kahjude katmiseks konventsiooniga kehtestatud vastutuskindlustuse ulatuses, mis sõltub laeva mahutavusest. Konventsiooni ratifitseerimine avaldab positiivset mõju keskkonnakaitsele ja inimese tervisele, sest võimaldab õnnetuse korral tõhusamalt reageerida ja võimaliku reostuse levikut takistada. Praeguseks on konventsiooni ratifitseerinud või sellega ühinenud 40 riiki, neist 13 Euroopa Liidu riigid. Eesti on konventsioonile alla kirjutanud 28. märtsil 2008. Konventsioon jõustub Eesti suhtes kolm kuud pärast päeva, mil ratifitseerimiskiri antakse hoiule Rahvusvahelise Meresõiduorganisatsiooni (International Maritime Organization, IMO) peasekretärile. Konventsiooni täitmiseks on vaja muuta meresõiduohutuse seadust, mille muutmise seaduse eelnõu on kooskõlastamisel. Muudatuste kohaselt hakkab konventsiooni kohaseid tunnistusi väljastama Veeteede Amet, mis toob neile kaasa mõningase töökoormuse kasvu.
