Summary
Eelnõuga võetakse üle Euroopa Liidu direktiivid, mis reguleerivad EL-i ülese raudteepiirkonna loomist ning vedurijuhtide sertifitseerimist. Muudatused muudavad raudteeturu läbipaistvamaks ja tõhustavad koostööd, et hõlbustada rahvusvahelisi raudteevedusid, stimuleerida usaldusväärset ja jätkusuutlikku rahastamist, suurendada Eestis Konkurentsiameti pädevust. Muudatused puudutavad eelkõige raudtee-ettevõtjaid, kes peavad vajadusel tegema muudatusi oma äristruktuuris, et eraldada teenindusrajatise käitamine muust tegevusest. Raudteeinfrastruktuuri-ettevõtja peab võrgustiku teadaandes andma täpsemat teavet infrastruktuuri kasutamise tingimuste kohta. Raudteeinfrastruktuuri jätkusuutlikkuse tagamiseks on riik kohustatud jälgima, et infrastruktuuri-ettevõtja oleks võimeline ka infrastruktuuri arendama vastavalt riigiga sõlmitud kokkulepetele, mis tähendab, et vajadusel tuleb riigil infrastruktuuri-ettevõtjasse rahaliselt panustada. Eelnõuga täpsustatakse vedurijuhtide perioodilise vahekontrolli nõudeid, mille kohaselt peab kontrollima ka keeleoskust, kui raudteeinfrastruktuuri-ettevõtja poolt raudteel kasutamiseks määratud keel ei ole vedurijuhi emakeel. Keeleoskus on oluline, et vedurijuht ja dispetšer saaksid teineteisest kindlasti aru, vastasel juhul võivad arusaamatuste tõttu tekkida ohtlikud olukorrad. Eelnõu täpsustab Tehnilise Järelevalve Ameti (TJA) käitumisjuhendit, kui vedurijuht ei vasta kehtestatud nõuetele.
