Summary

The draft will bring the laws into line with the EU plant health regulation and the regulation governing official inspections, which will apply from December 14, 2019. For this purpose, several provisions of the Plant Protection Act, the Organic Agriculture Act, the State Fee Act and the Plant Propagation and Variety Protection Act will be updated or repealed. In addition, the Plant Protection Act will be amended due to the amendment of the corresponding ELI directive. In the Plant Protection Act an important change is the extension of the obligation to submit an economic activity notification to almost all entrepreneurs engaged in the sale of plant planting material. The requirement for an activity permit is also established for those entrepreneurs who want to deal with, for example, wooden packaging material for entrepreneurs who want to issue a plant passport. Funding principles for plant health follow-up are changing. The primary supervision operation is still financed from the state budget. The monitoring fee is established for an inspection that was not initially planned to be carried out, but which is necessary due to a violation discovered during an official inspection. State fees in the field of plant health have also been updated to cover the costs of official inspections. The Organic Agriculture Act establishes the general basis for official inspection and the requirements for sampling and analysis. As a change, the imported organic product will no longer be issued marketing authorizations because the corresponding EU import system has changed. At the same time, state fees for the supervision of organic production will be updated in order to compensate for the increase in supervision costs resulting from the rapid development of the organic agriculture sector.
