Summary
Eelnõuga viiakse seadused kooskõlla EL-i taimetervise määruse ja ametliku kontrolli tegemist reguleeriva määrusega, mida kohaldatakse alates 14. detsembrist 2019. Selleks ajakohastatakse või tunnistatakse kehtetuks mitmed taimekaitseseaduse, mahepõllumajanduse seaduse, riigilõivuseaduse ning taimede paljundamise ja sordikaitse seaduse sätted. Lisaks muudetakse taimekaitseseadust tingituna ELI vastava direktiivi muutmisest. Taimekaitseseaduses on oluliseks muudatuseks majandustegevusteate esitamise kohustuse laiendamine pea kõigile taimse istutusmaterjali müügiga tegelevatele ettevõtjatele. Tegevusloa nõue kehtestatakse ka neile ettevõtjatele, kes soovivad tegeleda näiteks puidust pakkematerjaliga ettevõtjatele, kes soovivad väljastada taimepassi. Muutuvad taimetervise järelkontrolli rahastamise põhimõtted. Esmane järelevalvetoiming rahastatakse endiselt riigieelarve vahenditest. Järelevalvetasu kehtestatakse kontrolli eest, mida esialgu ei olnud kavas teha, kuid mis on vajalik ametliku kontrolli käigus avastatud rikkumise tõttu. Ajakohastatud on ka taimetervise valdkonna riigilõivud, et katta ametliku kontrolli kulud. Mahepõllumajanduse seaduses kehtestatakse ametliku kontrolli tegemise üldised alused ning proovide võtmise ja analüüsimise nõuded. Muudatusena ei väljastata enam imporditud mahepõllumajandusliku toote turuleviimise lubasid, sest vastav EL-i impordisüsteem on muutunud. Ühtlasi ajakohastatakse mahepõllumajandusliku tootmise järelevalvetoimingute riigilõivud, et kompenseerida mahepõllumajanduse sektori kiirest arengust tulenev järelevalve kulude suurenemine.
