Summary
Valitsuse 11. jaanuaril algatatud autoriõiguse seaduse muutmise seaduse eelnõuga (163 SE) võetakse üle EL-i vastav direktiiv, mille tähtaeg on 10. aprill 2016. Direktiivi eesmärk on ühtlustada Euroopa Liidu tasandil kollektiivse esindamisega seotud organisatsioonide tegevuse aluspõhimõtteid, luua mehhanism EL-i üleste litsentside andmiseks muusikateoste kasutamisel ning kehtestada järelevalve kohustus kollektiivse esindamise organisatsioonide tegevuse üle. Kollektiivse esindamise organisatsioonid on ühingud, kes annavad oma liikmete - autorite, esitajate, tootjate - loa alusel litsentse teoste kasutamiseks erinevatele ettevõtetele nagu näiteks poodidele, kaubanduskeskustele, restoranidele, hotellidele või meediateenuste pakkujatele. Hetkel on selliste ühingute tegevuse vahel EL-is märkimisväärsed erinevused, eelkõige seoses nende läbipaistvusega ning aruandluskohuslusega oma liikmete ja õiguste omajate ees. Eestis on neli suuremat kollektiivse esindamise organisatsiooni: Eesti Autorite Liit, Eesti Esitajate Liit, Eesti Fonogrammitootjate Ühing ning Eesti Audiovisuaalautorite Liit. Eesti esindusühingute tegevust puudutav regulatsioon muutub tulenevalt direktiivist tunduvalt detailsemaks. Lisaks luuakse mehhanism riikliku järelevalve teostamiseks kollektiivse esindamise organisatsioonide tegevuse üle ning järelevalveasutuseks on justiitsministeerium. Kõigil huvitatud isikutel on võimalus teada anda, kui nende meelest on autoriõiguse seadusest tulenevaid ja ühingute tegevust puudutavaid nõudeid rikutud.
