Summary
Eelnõu muudab seaduse elektroonilist teabevahetust reguleerivaid sätteid. Muudatuse tulemusel vabaneb hankija elektroonilise teabevahetuse kohustusest sellistes riigihangetes, mille maksumus on väike, s.o asjade ja teenuste puhul alla 30 000 euro ja ehitustööde puhul alla 60 000 euro. Kehtiv seadus kohustab kõrge turvatasemega elektroonilist teabevahetust kasutama iga riigihanke puhul, sõltumata maksumusest. Muudatuse eesmärgiks on võimaldada väikese maksumusega riigihangetes lihtsamat elektroonilist teabevahetust, (nt e-kirja teel), millega vähendatakse oluliselt hankijate töökoormust ning pakkujate halduskoormust. Raamlepingu alusel korraldatavates minikonkurssides ei kohalduks elektroonilise teabevahetuse kohustus, kui sõlmitava hankelepingu eeldatav maksumus jääb alla lihthanke piirmäära ehk asjade ja teenuste puhul alla 30 000 euro. Nende riigihangete puhul, mille puhul seadus lihthanke piirmäära ette ei näe, kohalduks elektroonilise teabevahetuse kohustus alates riigihanke piirmäärast. Kultuuriministeeriumi ettepanekul on pärast kooskõlastusringi lisatud kunstiteoste tellimise seaduse muudatus, millega tõstetakse piirmäära, alates millest tuleb seoses ehitustööde tellimisega läbi viia ka kunstiteoste tellimine. Praegune piirmäär on 450 000 eurot tõstetakse 750 000-le eurole. Lisaks antakse keskkonnaministrile volitus kehtestada kohustuslikud keskkonnahoidlikud kriteeriumid hangetes, millega ostetakse mööblit, puhastustooteid ja –teenuseid, kontori IT seadmeid, koopia- ja joonestuspaberit.
