Summary
Eelnõuga tehakse seadusesse muudatused, millega täpsustatakse maapõuevaldkonna ülesannete jaotust Keskkonnaministeeriumi ning Majandus- ja Kommunikatsiooniministeeriumi vahel. Eelnõuga lisatakse Majandus- ja Kommunikatsiooniministeeriumi valitsemisala kirjeldusse maapõueressursside valdkond ning määratakse tegevustena ka geoloogiline kaardistamine ja riikliku geoloogilise kompetentsi tagamine. Valdkond hõlmab nii Majandus- ja Kommunikatsiooniministeeriumi hallatava Eesti Geoloogiateenistuse põhitegevust kui ka olemasolevaid seda koordineerivaid ametikohti ministeeriumi enda koosseisus. Kehtiva seaduse kohaselt on maapõue tegevusega seotud teemad Keskkonnaministeeriumi valitsemisalas. Majandus- ja Kommunikatsiooniministeeriumi valitsemisala ülesandeks on maavarade vajaduse prognoosimine, maavaradega seotud sotsiaal-majanduslike mõjude hindamine, maapõue majandusliku potentsiaali kasutamiseks ning arendamiseks vajaliku teadus- ja arendustegevuse koordineerimine, maapõuealaste uuringute koordineerimine ja rahastamine, geoloogilise kaardistamise läbiviimine ja rahastamine. Keskkonnaministeeriumi valitsemisalasse jääb strateegiline planeerimine (ressursitõhusus, saastetasud, jäätmetekke vähendamine), üldgeoloogilise uurimistöö lubade, geoloogilise uuringu lubade ja maavara kaevandamise lubade andmine ning muude maapõue ja maavarade kasutamise ja kaitse alaste kooskõlastuste ja lubade andmine.
