Summary
Eelnõu viib seadustiku vastavusse EL-i nõuetega, mis käsitlevad eurode võltsimist ja muude vääringute kaitset. EL-i vastav direktiiv peab olema Eesti õigusesse üle võetud 23. maiks 2016. Eelnõu näeb ette senisest rangema karistuse raha, pangakaardi ja muu maksevahendi, väärtpaberi, maksumärgi ning proovijärelevalve märgise võltsimise ettevalmistamise eest. Praegu on nende kuritegude eest ette nähtud rahaline karistus. Eelnõu lisab sellele kuni kaheaastase vangistuse. Samuti antakse võimalus teha nende kuritegude avastamiseks või tõkestamiseks jälitustoiminguid. Väärteokaristus nähakse ette ka selle eest, kui krediidi- või finantseerimisasutuse või raha käitlemises osaleva muu asutuse selleks kohustatud juht või töötaja jätab pangatähtede ja müntide ehtsuse ja ringluskõlblikkuse kontrollimata. Samuti täpsustatakse raha võltsimise ja võltsitud maksevahendi ja väärtpaberi käitlemise kuritegude koosseise. Need kuriteod on karistatavad olenemata sellest, kas võltsimine pandi toime seaduslikke või ebaseaduslike vahendite abil.
