Summary
Eelnõuga kavandatav muudatus puudutab sama valla või linna ametiasutuses töölepingu alusel töötavaid inimesi, kellel senise volituste lõppemise asemel kohaldatakse edaspidi volikogu liikme volituste peatumist. Ametnikke kavandatav muudatus ei puuduta. Eelnõu algatamise ajendiks on õiguskantsleri vastavasisuline taotlus Riigikohtule seisukoha võtmiseks. Riigikohus leidis, et kehtestatud piirangud omavalitsuse ametiasutuste töölepingulistele töötajatele ei ole vajalikud ning piiravad ülemääraselt kandideerimisõigust. Tulenevalt sellest peab ka komisjon vajalikuks piirangu pehmendamist ja toetab volituste lõpetamise asemel volituste peatamist. Seadus on kavandatud jõustuma 17. oktoobril, mil jõustub ka Riigikohtu otsus. Sellest kuupäevast alates ei saa enam omavalitsuse ametiasutuse töötajatest volikogu liikmete volitusi ennetähtaegselt lõpetada.
