Summary
Eelnõu teeb töövõimereformiga seotud muudatused kaitseministeeriumi valitsemisalas. Kaitseliidu seadus, kaitseväeteenistuse seadus ja riigikaitseliste sundkoormiste seadus viiakse kooskõlla 1. juulil 2016 jõustuva töövõimetoetuse seadusega, säilitades kaitseväelastele ettenähtud sotsiaalsed tagatised praegusel kujul. Võrreldes teiste valdkondadega tekib kaitseväeteenistuses kõige enam tervisekahjustusi ning teenistusülesannete täitmisel saadud vigastused on ühtlasi väga erineva raskusastmega. Töövõimereformi käigus toimuv üleminek osalise või puuduva töövõime hindamisele tähendaks kaitseväelastele ettenähtud tagatiste olulist vähenemist, mistõttu säilitatakse nende puhul ka edaspidi ühekordse hüvitise maksmine vastavalt saadud vigastuse raskusastmele. Kaitseministeeriumi valitsemisalas jätkab kaitseväe arstlik komisjon püsiva töövõimetuse ulatuse tuvastamist ja selle väljendamist töövõime kaotuse protsentides. Samuti säilib kaitseväeteenistuse seaduse alusel töövõimetus- ja toitjakaotuspensioni perioodiline maksmine, et tagada kaitseväelastele suurem kindlustunne kõrgema riskiastmega teenistusülesannete täitmisel. Lisaks töövõimetuse tuvastamisega seotud muudatustele ühtlustatakse eelnõuga kaitseväeteenistuse seaduses ette nähtud sotsiaalteenuste ja abivahendite tagamise korraldust töövõimereformi käigus tehtavate muudatustega. Muudatused on kavas jõustada samal ajal töövõimetoetuse seadusega, 1. juulil 2016.
