Summary
Eelnõu sätestab täiendava aluse üldhariduskoolist õpilase väljaarvamiseks, samuti sätestatakse seaduse tasemel alused õpilase kutseõppeasutusest väljaarvamiseks ja lapse koolieelsest lasteasutusest väljaarvamiseks. Eelnõu järgi saab üldhariduskooli nimekirjast õpilase välja arvata ka alusel, kui õpilasel puuduvad Eesti elukoha andmed, välja arvatud juhul, kui on teada, et õpilane viibib Eestis ning vanem on esitanud kinnituse õpingute jätkamiseks selles koolis. Analoogne alus sisaldub ka õpilase kutseõppeasutusest väljaarvamiseks ja lapse koolieelsest lasteasutusest väljaarvamiseks. Eelnõuga nähakse tervikuna ette õpilase kutseõppeasutusest väljaarvamise alused, mis seni sisalduvad peamiselt kooli nõukogu kehtestatud õppekorralduseeskirjas. Alused on sarnased õpilase üldhariduskoolist väljaarvamise alustega (nt lõputunnistuse väljastamisel, vanema taotlusel, rikub korduvalt kodukorda jm). Eelnõu järgi kehtestatakse tervikloeteluna ka lapse koolieelsest lasteasutusest väljaarvamise alused (nt vanema taotlusel, koolikohustuse täitma asumisel jm). Kehtiva korra järgi kehtestab laste lasteaeda vastuvõtmise ja sealt väljaarvamise korra valla- või linnavalitsus. Seletuskirjas märgitakse, et eelnõu seadusena vastuvõtmine ei too kaasa kulusid, samuti olulisi täiendavaid tegevusi. Eelkõige on vaja lahendada küsimus näiteks Ukrainast Eestisse saabunud isikute osas, kui laps on kantud kooli või lasteaia nimekirja, aga õppe- ja kasvatustegevuses ei osale näiteks põhjusel, et pere on riigist lahkunud ja vanem ei ole kooli või lasteaeda sellest teavitanud.
