Summary
Eelnõu eesmärk on võimaldada kiiremat ja efektiivsemat kaitset autoriõiguse, autoriõigusega kaasneva õiguse või tööstusomandiõiguse väidetava rikkumise asjades. Selleks nähakse eelnõuga nendes asjades ette võimalus taotleda kohtult hagi tagamise korras, et vahendaja, kelle teenuseid õiguste rikkumisel kasutatakse, rakendaks meetmeid rikkumise peatamiseks või ärahoidmiseks. Intellektuaalomandi õiguse rikkumise korral, mis seisneb teatud sisu internetis kättesaadavaks tegemises, võimaldavad eelnõuga tehtavad muudatused nõuda vahendajalt näiteks vastava sisu ajutiselt mahavõtmist või sellele juurdepääsu takistamist kohtumenetluse ajaks. Eriti internetis toimuva rikkumise puhul on vahendaja sageli kõige paremas positsioonis rikkumise kiireks ja tõhusaks peatamiseks. Kohustus võimaldada õiguste omajatel taotleda intellektuaalomandi õiguse rikkumise korral kohtult esialgsete ja ennetavate ettekirjutuste tegemist ka vahendajate suhtes tuleneb Euroopa Parlamendi ja nõukogu direktiividest.
