Summary
Eelnõuga muudetakse nn tühja kasseti tasu ehk autori õigust saada hüvitist, kui tema teost kopeeritakse tema nõusolekuta isiklikuks kasutamiseks. Kehtiva õiguse kohaselt määratakse tühja kasseti tasu suurus seadusega ning salvestusseadmed ja -kandjad, millelt tasu küsitakse, kehtestatakse valitsuse määrusega. Eelnõu kohaselt kehtestatakse nii salvestusseadmete kui –kandjate loetelu kui ka tasu suurus valitsuse määrusega. Eelnõu kohaselt on tasu maksimaalne määr 6 eurot, kuid mitte rohkem kui 15 protsenti vastava salvestusseadme või -kandja keskmisest hulgimüügi hinnast Eestis. Uuendusena hakatakse tühja kasseti tasu jagama ka filmi esmasalvestuse tootjatele. Eelnõuga planeeritavad muudatused on vajalik, et kehtestada modernne ja paindlik tasu kogumise süsteem, mis võimaldaks õiglast tasu koguda ka näiteks nutiseadmetelt. Eelnõu kohaselt annab Justiitsministeerium autoriõigusega seotud rakenduslikud ülesanded üle Patendiametile.
