Summary
Eelnõuga ajakohastatakse ja täiustatakse riigivara kasutamiseks andmist ja riigivara valitsejate vahelisi kasutusvõimalusi reguleerivaid õigusnorme, võttes arvesse majandusliku ja tehnoloogilise keskkonna arengut. Seletuskirja kohaselt on praktikas selgunud, et kehtiv regulatsioon ei arvesta intellektuaalse vara kasutamisega (sh kasutamiseks andmisega) seotud iseärasustega, eeskätt riigile kuuluva tarkvaraga seotud tehingutes. Kehtivas õiguses puuduvad selged alused tarkvara avalikkusele tasuta kasutamiseks andmiseks ning tarkvara riigivara valitsejate vaheliseks samaaegseks kasutamiseks (nn tarkvara ristkasutuseks). Kokkuvõtvalt on eelnõu eesmärk sätestada seaduses ühtsed ja selged alused riigi tarkvara avalikkusele tasuta kasutamiseks andmiseks ja riigivara valitsejate vaheliseks riigi tarkvara ristkasutuseks.
