Summary
Eelnõuga ajakohastatakse sätteid, et tagada EL-i õiguse rakendamine. Euroopa Komisjon on kehtestanud uued Euroopa Liidu kasvuhoonegaaside lubatud heitkoguse ühikutega kauplemise süsteemi (EL HKS) rakendavad määrused. Samuti on EL andnud rakendusmääruse moderniseerimisfondi kohta. Nende eesmärk on hoogustada heitkoguste kulutõhusat vähendamist ja süsinikdioksiidiheite vähendamist toetavaid investeeringuid. Määrustes on sätestatud ELi HKSi toimimise üksikasjad neljandaks kauplemisperioodiks aastatel 2021–2030. Eelnõu kohaselt muudetakse paindlikumaks tasuta lubatud heitkoguse ühikute eraldamine käitlejate jaoks. See vähendab halduskoormust, kuna käitajatel on võimalik aruannet, mille põhjal ühikuid kohandatakse, esitada koos heitkoguse aruandega 25. märtsiks. Ühikute jooksev kohandamine igal aastal tagab õiglasema ühikute eraldamise. Eelnõuga määratakse edaspidi moderniseerimisfondi vahendite kasutamise jaotus ja vahendite kasutamise eest vastutavad ministrid riigi eelarvestrateegias. Eelarvestrateegias otsustatud meetmetega on võimalik suunata moderniseerimisfondi vahendid riigile olulistesse valdkondadesse, et saavutada kliima- ja energiapoliitika eesmärke. Samuti võimaldab see luua igale meetmele ühtsed alused kõikidele taotlejatele konkreetsesse valdkonda investeerimiseks. Erinevate meetmete kaudu on võimalik toetada taastuvenergia, energiatõhususe, energia salvestamise, energiavõrkude moderniseerimise projektide elluviimist, samuti vähese CO2-heitega majandusele õiglast üleminekut piirkondades, mis tuginevad suure CO2-heitega majandusele, näiteks Ida-Virumaal. Samuti on võimalik toetada moderniseerimisfondi vahenditest erinevate meetmetega energiatõhususe arendamist transpordi, hoonete, põllumajanduse ja jäätmete valdkonnas. Jagatud kohustuse määruse alusel on Eestil kohustuslikud iga-aastased kasvuhoonegaaside heite piiramise sihttasemed aastateks 2021–2030 transpordi, põllumajanduse, jäätmekäitluse, tööstuslike protsesside ja väikesemahulise energiatootmise sektorites. Eesmärkide täitmise tagamiseks on liikmesriikidel lubatud määruse alusel loodud heitkoguse ühikutega omavahel kaubelda. Seega sätestatakse jagatud kohustuse määruse sektorites heitkoguse ühikutega kauplemise põhimõtted ning kauplemise korraldamise, müügi- ja ostulepingute, kauplemisest saadud vahendite kasutamise tingimused ja kord ning taotleja kohustused.
