Summary
Seaduse muutmisega lihtsustatakse postisaadetiste tollikontrolli nii tolli kui postiteenuse osutajate jaoks. Samuti tõhustatakse keelatud ja piirangutega kaupade Eestisse saatmise tõkestamist. Eelnõuga täpsustatakse postisaadetise läbivaatuse akti vormistamise korda. Nähakse ette, et postisaadetise läbivaatuse akti ei vormistata, kui postisaadetis vaadatakse läbi postiteenuse osutaja juuresolekul ja läbivaatuse käigus ei avastata korrarikkumisele viitavaid asjaolusid. Kehtiva õiguse järgi tuleb iga postisaadetise läbivaatust alati protokollida. Läbivaatuse puhul postisaadetise avab ja sulgeb postiteenuse osutaja vastutav töötaja tolli juuresolekul ning iga postisaadetise avamise kohta koostatakse protokoll postiseaduse alusel olenemata sellest, kas tuvastatakse rikkumine või mitte. Eelnõuga täpsustakse postisaadetises sisalduvate keelatud või piiranguga kaubaga tehtavaid riikliku järelevalve toiminguid. Järelevalve vajab täpsustamist, sest kehtivad sätted reguleerivad vaid liiduvälisest riigist saabunud rahvusvahelise postisaadetise läbivaatamist. Õigusselguse huvides on oluline, et tolli pädevus liidu sees liikuvate posti- ja kullersaadetiste läbivaatamisel oleks samuti tolliseadusega reguleeritud. Nt püütakse väikesaadetistes Eestisse keelatud kaupu tellida.
