Summary
Seaduse muutmisega laiendatakse selle reguleerimisala, et ennetada ja vähendada tubaka- ja nendega seonduvatest toodetest tuleneva sõltuvuse ja tervisekahjude levikut ühiskonnas. Lisatakse tubakatoodete ja nendega seonduvate toodete väljapaneku keeld ning nende kaubamärkide esitlemise keeld jaekaubanduse müügikohtades. Erandid jäävad spetsialiseerunud jaemüügikohtadele, rahvusvahelisel liinil sõitvatele laevadele ning lennujaama ja sadama kinnisel territooriumil asuvatele kauplustele. Lisaks laiendatakse kehtiva tubakaseaduse müügiedenduse sätteid tubakatootega seonduvatele toodetele (nt ei tohi pakkuda loosimise võidu, auhinna või muu hüvena) ning keeldu müüa tubakatootega seonduvat toodet mõne teise tootega (nt mobiilikott, tuhatoos) samas müügipakendis. Eelnõuga piiratakse e-sigarettide kättesaadavust ja tarvitamist. E-sigareti kasutamine on edaspidi lisaks lasteasutustele keelatud kõigis teistes suitsetamiseks keelatud kohtades (nt toitlustusettevõtetes, kauplustes). Senisele piiriülesele kaugmüügi keelule lisandub riigisisene kaugmüügi keeld tubakatoodetele ja nendega seonduvatele toodetele, sh e-sigarettidele. See tähendab, et edaspidi ei saa sidevahendite kaudu (nt e-kaubanduse või kataloogi teel) neid tooteid osta. Eelnõuga kehtestatakse nõuded ka elektroonilise sigareti nikotiinisisalduseta vedeliku koostisele ja puhtusele (nt ei tohi vedelik sisaldada vitamiine, kofeiini ega muid aineid, mida seostatakse jõu ja energiat andva mõjuga) ning keelustatakse tubakast erinevad maitsed e-sigarettides. Eelnõuga tehakse kohustuslikuks dokumendi küsimine tubaka- või sellega seonduvat toodet ostvalt kliendilt, välja arvatud juhul, kui tegemist on ilmselgelt täisealise või müüjale tuttava isikuga. Maksu- ja Tolliametile antakse kontrollostu õigus salatubaka müügi kindlakstegemiseks ning politseiametnikele alaealistele tubakatoodete või seonduvate toodete müügi kindlakstegemiseks koos õigusega vajaduse korral kaasata kontrollostu tegemisse vähemalt 16-aastaseid isikuid. Seadus jõustub üldises korras. Müügiedenduse keelule, väljapaneku ja kaubamärkide esitlemise keelule, riigisisese kaugmüügi keelule, maitse- ja lõhnaainete keelule e-sigarettides (lubatud on ainult tubaka maitse ja lõhn), keelule müüa tubakatootega seonduvat toodet muu tootega ühtses pakendis ning kehtivatele pakenditele märgistuse nõuete laiendamine ka pakenditesse lisatavatele trükistele on üleminekuaeg 1. jaanuarini 2019.
