Summary
Loovisikute ja loomeliitude seadust muudetakse, et seaduses ette nähtud reservi saaks täiendavalt paigutada lisaraha. Vabakutseliste loovisikute osa loomesektoris tervikuna on suurenenud ning ka töö tegemise viisid muutunud. Kindla tööandjata sihtrühm on kultuurivaldkonnas üks rohkem kannatanud tööturu osalisi. Eelnõuga võimaldatakse maksta suuremale hulgale loovisikutele loometoetusi ning seoses koroonakriisiga leevendatakse ajutiselt ka toetuse taotlemise tingimusi. Loometoetus on kuue kuu jooksul makstav töötasu alammäära (584 eurot) suurune toetus. Kuni 2021. aasta lõpuni kaotatakse nõue loometoetust saanul kahe aasta jooksul uut toetust mitte taotleda. Samuti on tal õigus saada loometoetust ka juhul, kui loometoetuse maksmisele eelnenud kuul on saadud kuni ühe loometoetuse suuruses tulu, töövõimetoetust või töövõimetuspensioni. Sarnased muudatused tehti seadusesse ka aasta tagasi, 2020. aasta kevadel jõustunud seadusemuudatusega, kuid need kehtisid eriolukorra ajal ja kuus kuud pärast selle lõppu. Püsiva iseloomuga muudatused puudutavad loomeliidu toetuse kujunemise aluseid. Muudatusega nähakse ette, et loometoetuse reservi võib erandjuhul suurendada riigieelarvest või valitsuse selleks eraldatud vahenditest, kui seaduse sätestatud alusel eraldatud summast loometoetuste maksmiseks abivajajatele ei piisa. Püsiva iseloomuga on ka muudatus, millega määratakse nende vabakutseliste loovisikute, kes ei kuulu ühtegi loomeliitu, loometoetuste taotluste menetlejaks ja toetuste maksjaks Kultuuriministeerium. Kehtiva seaduse alusel on see ülesanne loomeliitudel. Lisaks täpsustakse sotsiaalmaksu arvestamise korda olukorras, kus loovisik kuulub korraga mitmesse loomeliitu.
