Summary

The draft adopts two copyright directives of the European Union that entered into force in the summer of 2019, which were part of the so-called copyright reform package published by the European Commission in September 2016 (transition deadline June 7, 2021). The changes in the law ensure better access to copyrighted content for consumers, while also protecting the rights of authors and performers. The changes will improve the negotiating position of authors and performers when concluding copyright contracts, obliging the other party to the contract to provide them with information about the use of rights at least once a year. It is also possible to conclude extended collective license agreements for the use of works, if obtaining permission from each individual rights holder would be excessively burdensome for the user, for example, this concerns television or radio service offers. Among other things, obligations are also imposed on online platforms (e.g. YouTube, Facebook), whose main purpose is to enable users of the service to upload content and access works, performances and other content that may be protected by copyright or copyright related rights (video clips from concerts, excerpts from films and TV series, music recordings, etc.). It also adds to the cases of free use, when users are allowed to use a protected work or copyrighted rights object (e.g. performance or phonogram) without the consent of the rights holder and without payment of a fee. For example, the use of works without the consent of the author and without payment of royalties is allowed for text and data mining purposes, both for commercial and non-commercial purposes. By applicable law, this is only permitted for non-commercial purposes. In addition, better opportunities from trade turnover are created for institutions dealing with cultural heritage (libraries, museums, archives) for the use of outdoor works in the presentation of cultural heritage.
