Summary
Eelnõuga võetakse üle kaks Euroopa Liidu 2019. aasta suvel jõustunud autoriõiguse direktiivi, mis olid osaks Euroopa Komisjoni poolt 2016. aasta septembris avaldatud nn autoriõiguse reformipaketist (ülevõtmistähtaeg 7. juuni 2021). Seadusemuudatustega tagatakse tarbijale parem juurdepääs autoriõigusega kaitstavale sisule, kaitstes samas ka autorite ja esitajate õigusi. Muudatustega parandatakse autorite ja esitajate läbirääkimispositsiooni autorilepingute sõlmimisel, kohustades teist lepingupoolt andma neile vähemalt kord aastas infot õiguste kasutamise kohta. Samuti antakse võimalus laiendatud kollektiivsete litsentsilepingute sõlmimiseks teoste kasutamisel, kui igalt üksikult õiguste omajalt loa saamine oleks kasutajale liigselt koormav, see puudutab näiteks televisiooni või raadioteenuste pakkumisi. Muuhulgas kehtestatakse ka kohustused veebiplatvormidele (nt YouTube, Facebook), kelle peamine eesmärk on võimaldada teenuse kasutajatel laadida sisu üles ning pääseda ligi teostele, esitustele ja muule sisule, mis võivad olla kaitstud autoriõiguse või autoriõigusega kaasnevate õigustega (videoklipid kontsertidest, väljavõtted filmidest ja teleseriaalidest, muusikasalvestised jne). Samuti täiendatakse vaba kasutuse juhtusid, mil kasutajatel on lubatud kasutada kaitstud teost või autoriõigusega kaasnevate õiguste objekti (nt esitust või fonogrammi) ilma õiguste omaja nõusolekuta ja tasu maksmata. Näiteks võimaldatakse teoste kasutamine ilma autori nõusolekuta ja autoritasu maksmata teksti- ja andmekaeve eesmärkidel nii ärilistel kui mitteärilistel eesmärkidel. Kehtiva õiguse järgi on see lubatud vaid mitteärilistel eesmärkidel. Lisaks luuakse kultuuripärandiga tegelevatele asutustele (raamatukogud, muuseumid, arhiivid) paremad võimalused kaubanduskäibest väljas olevate teoste kasutamiseks kultuuripärandi tutvustamisel.
