Summary
Eelnõuga sätestatakse ebaausate kaubandustavadena tehingud ja teod, mis on seotud maksetähtaegade, tarnete ja müügitingimustega ning mis on põllumajandustoodete ja toidu tarneahelas ostja ja müüja vahel keelatud. Loetletud on 16 ebaausat kaubandustava, millest üheksa on igal juhul ja alati keelatud. Näiteks ostja ei tohi muuta ühepoolselt müügilepingu tingimusi, tühistada tellimusi nii lühikese etteteatamisega, et ei saa mõistlikult eeldada, et müüja leiab tootele muu turustus- või kasutusvõimaluse, ähvardada müüjat kaubanduslike survemeetmetega jne. Ülejäänud seitse ebaausat kaubandustava on keelatud juhul, kui eelnevalt ei ole nendes selgelt ja ühemõtteliselt kokku lepitud. Näiteks, kui ei ole kirjalikult tarnelepingus kokku lepitud põllumajandustoote ja toidu allahindluse kulude katmine, siis sel juhul kui ostja nõuab selliste kulude katmist, loetakse seda ebaausaks kaubandustavaks. Need tehingud ei loo õiguslikke tagajärgi ja on kehtetud algusest peale. Järelevalvet kaubandustavade üle hakkab tegema Konkurentsiamet, kus luuakse selleks kuue ametikohaga struktuuriüksus. Samuti peab Konkurentsiamet hakkama avaldama vastavat aastaaruannet ning esitama Euroopa Komisjonile iga aasta 15. märtsiks ülevaate seaduse nõuete kohaldamise ja nende täitmise tagamise kohta. Ebaausa kaubandustava keelu rikkumise kohta nähakse ette ka vastutus. Füüsilisele isikule on ette nähtud kuni 300 trahviühiku või aresti kohaldamine ja juriidilisele isikule rahatrahv kuni 400 000 eurot. Eelnõu eesmärk on kaitsta põllumajandustoote ja toidu müüjaid ostjate ebaausate kaubandustavade eest. Eelnõuga võetakse üle Euroopa Parlamendi ja nõukogu direktiiv, mis käsitleb põllumajandustoodete ja toiduainete tarneahelas ettevõtjate vahelistes suhetes esinevaid ebaausaid kaubandustavasid.
