Summary
ELi loomatervise määruse rakendumisega ajakohastatakse Eesti õigusaktid. Senised siseriiklikud loomatervishoidu käsitlevad õigusaktid koondatakse ühtseks veterinaarseaduseks, mille eesmärk on koondada, ühtlustada ja ajakohastada valdkonna õigus, rakendada ELi loomatervise määrust ja teisi veterinaaria valdkonna ELi vahetult kohaldatavaid määruseid, sõnastada ELi liikmesriigi pädevusse jäävad sätted, rakendusprotseduurid ja volitusnormid, mis on vajalikud nõuete täpsemaks esitamiseks. Uus seadus aitab tagada ettevõtja jaoks parema õigusselguse ja Eesti õiguse sidususe ELi õigusaktidega. Oluliseks muudatuseks on ettevõtjate puhul teatud tegevusaladel loakohustuse muutumine teatamiskohustuseks, uued teatamiskohustused seoses maismaaloomade pidamisega ning uued loakohustused seoses ELi ühisturul kauplemisega. Teatud põllumajanduslooma puhul peab selle pidaja hakkama koostama bioturvalisuse kava. Läbimõeldud meetmed loomataudi ärahoidmiseks aitavad ära hoida loomataudide leviku. Nõue kehtib juba praegu seakasvatus- ja vesiviljelusettevõtetele. Edaspidi võib seda nõuet laiendada riskipõhiselt. Loomaliigid, kelle pidamisel tuleb bioturvalisuse kava koostada, kehtestab valdkonna eest vastutav minister oma määrusega. Bioturvalisuse kava ei pea koostama kodumajapidamises oma tarbeks peetava põllumajanduslooma pidamise korral. Seoses ELi loomatervise määruse kohaldumisega muutuvad mõnevõrra loomataudi ennetuse ja tõrje alused. Eriti ohtlike loomataudide tõrje korraldamine toimub Põllumajandus- ja Toiduameti koostatava situatsioonplaani alusel. Kehtivas seaduses sätestatud kohalikke ja riiklikke loomatauditõrje komisjone enam ei moodustata. Loomataudiohu ja puhkemise korral lähtutakse ELi loomatervise määrusest, veterinaarseadusest, situatsioonplaanist ja hädaolukorra seadusest.
