Summary

The draft resolves bottlenecks that have emerged during the long-term practice of implementing the Foreign Relations Act. As one important change, the draft simplifies the procedure for the preparation and conclusion of international agreements in order to make it more efficient. The biggest proposed change concerns the submission of foreign treaty materials to the Ministry of Foreign Affairs and the processing of amendments to foreign treaties at different levels. Changes are also planned for the enforcement of foreign agreements, the procedure for raising objections to reservations and declarations and for suspending and terminating foreign agreements. With another important amendment, the authorization norms included in the Foreign Communications Act, including the authorization norms granted for the establishment of databases, and the data protection reform will be completed. In the Foreign Communications Act, the authorization norm for the establishment of several databases is a general authorization, which does not include the purpose or scope of infringement of fundamental rights. If personal data processing in the database leads to an additional violation, the purpose and scope of the violation of fundamental rights must be stipulated in the law. Organizing the establishment of databases and other authorization norms ensures legal clarity for the target groups. The bill does not create new databases and does not plan to change the functioning of the existing ones or the data processed in them.
