Summary
Eelnõuga lahendatakse välissuhtlemisseaduse rakendamise pikaajalise praktika käigus ilmnenud kitsaskohti. Ühe olulise muudatusena lihtsustatakse eelnõuga välislepingute ettevalmistamise ja sõlmimise menetlust, et muuta see tõhusamaks. Suurim kavandatav muudatus puudutab välislepingu materjalide välisministeeriumile esitamist ning välislepingute muudatuste menetlemist eri tasanditel. Muudatusi kavandatakse ka välislepingute jõustamise, reservatsioonidele ja deklaratsioonidele vastuväidete tegemise ning välislepingute peatamise ja peatamise lõpetamise korda. Teise olulise muudatusega korrastatakse välissuhtlemisseaduses sisalduvaid volitusnorme, sh andmekogude asutamiseks antud volitusnorme ning viiakse lõpule andmekaitsereform. Välissuhtlemisseaduses on mitme andmekogu asutamise volitusnormiks üldvolitus, mis ei sisalda põhiõiguste riive eesmärki ega ulatust. Kui isikuandmete töötlemine andmekogus toob kaasa täiendava riive, peab põhiõiguse riive eesmärk ja ulatus olema sätestatud seaduses. Andmekogude asutamise ja muude volitusnormide korrastamine tagab sihtrühmade jaoks õigusselguse. Eelnõuga uusi andmekogusid ei looda ega kavandata muuta olemasolevate toimimist ega neis töödeldavate andmetega seonduvat.
