Summary
Eelnõuga võetakse Eesti õigusesse üle konkurentsiõiguse eraõiguslikku rakendamist käsitlev direktiiv. Sätted reguleerivad muu hulgas nõudeid, mis tekivad konkurentsi kahjustavast kokkuleppest, ettevõtjate ühenduse otsusest või turgu valitseva seisundi kuritarvitamisest. Eelkõige puudutab see kartellikokkuleppeid ja monopoolse seisundi kuritarvitamisi. Direktiivi ülevõtmise tähtaeg oli 27. detsember 2016. Eelnõu kohaselt on igal vastava kahju kannatanul võimalus saada kahju täielikku hüvitamist, mis tähendab otsese varalise kahju, saamata jäänud tulu ning viiviste hüvitamist. Kehtiva õiguse kohaselt saab kannatanud kindlaks teha üksnes tõlgendamise teel ning üldjuhul saamata jäänud tulu nõuda ei saa. Eelnõuga muudetakse vastavate nõuete viivise arvutamise algust, mille kohaselt tuleb viivist tasuda kahju tekkimisest kuni kahju hüvitamiseni. Kehtiva õiguse kohaselt alates ajast, mil võlausaldaja teatas võlgnikule oma nõudest või esitas nõude hagi või maksekäsu kiirmenetluse avaldusena. Eelnõuga sätestatakse keelatud teo toimepanemisest tekkinud nõude aegumistähtajaks 5 aastat. Kehtiva õiguse kohaselt on nõude aegumistähtaeg 3 aastat. Lisaks direktiivi ülevõtmisele antakse eelnõuga konkurentsiametile taas õigus teostada haldusjärelevalvet, mis tähendab teha ettekirjutusi kohaliku omavalitsuse üksusele, riigiasutusele või muule haldusülesandeid täitvale isikule.
