Summary
Eelnõu tagab ELi digiteenuste (DSA) määruse nõuetekohase ja mõjusa täitmise, et paremini tõkestada ebaseadusliku veebisisu levikut, paremini kaitsta digiteenuste kasutajate sõna- ja teabevabadust ning ühtlustada digiteenustele kohalduvaid nõudeid Euroopa Liidu siseturul. DSA määrus seab eraldi kohustused väga suurtele digiplatvormidele, millel on ELis üle 45 miljoni kasutaja, näiteks Youtube, Facebook, Instagram, TikTok, X, Amazon, Booking.com. Määruse järgi on need platvormid kohustatud igal aastal hindama oma teenuste riske ebaseadusliku sisu levitamisele, põhiõigustele, sealhulgas sõnavabadusele, rahvatervisele, avalikule julgeolekule, alaealistele ning kehtestama meetmed nende riskide maandamiseks. DSA määrus muudab digiplatvormide tegevuse sisu modereerimisel ja seotud otsuste langetamisel läbipaistvamaks. Näiteks tekib kasutajatel õigus olla teavitatud, kui nende avaldatud sisu on eemaldatud või juurdepääs sellele takistatud ning miks seda on tehtud. Ühtlasi peavad digiplatvormid enda kasutajatingimustes arusaadavalt välja tooma, mis alustel ja kuidas nad sisu toimetavad. Saadud info võimaldab kasutajatel neid otsuseid vaidlustada ja oma õigusi kaitsta. Kasutajad saavad oma kaebused esitada otse platvormile, valida kohtuvälise vaidluste lahendamise organi või pöörduda kohtusse. Eestis hakkab järelevalvet tegema tarbijakaitse ja tehnilise järelevalve amet (TTJA), kes juba tegeleb sarnaste teemadega. Edaspidi on õigus esitada TTJAle kaebus, kui kahtlustad, et mõni digiteenus rikub DSA määruse nõudeid. Kui kaebust on pädev lahendama teise EL- i liikmesriigi pädev järelevalveasutus, edastab TTJA kaebuse edasi koos ameti arvamusega.
