Summary
Ehitusseadustikku muudetakse seoses ELi teetaristu ohutuse korraldamise direktiivi muudatuse Eesti õigusesse ülevõtmiseks. Et direktiivi reguleerimisala laiendati, siis selle tulemusel tuleb direktiiviga ettenähtud liiklusohutuse meetmed rakendada lisaks üleeuroopalise teedevõrgu TEN-T teedele, mis oli senine kohaldamisala, ka kõikidel põhimaanteedel ning ELi vahendite abil ehitatud avalikult kasutatavatel maanteedel. Pädev asutus, kelleks on valdavalt Transpordiamet, peab direktiivist tulenevalt hindama liiklusohutusele avalduvat mõju, viima läbi liiklusohutuse auditeerimist, hindama teedevõrgu liiklusohutust ning teostama perioodilist tee ohutuse kontrolli. Kui kohalikud omavalitsused (KOV) ehitavad tulevikus maanteid ELi vahendite kaasamisel, siis lisaks senistele TEN-T teedele tuleb KOVidel täita pädeva asutuse kohustusi ka nende poolt ELi vahenditega ehitatud maanteedel.
