Summary
Eelnõuga muudetakse tervishoiuteenuste korraldamise seaduses ette nähtud perearstide töökorraldust. Samuti muudetakse teisi seadusi, sh ravimiseadust ja riigilõivuseadust. Tervishoiuteenuste korraldamise seaduses antakse perearstidele võimalus teenindada inimesi ka oma nimistu väliselt ning luuakse täiendav alus nimistute ümberkorraldamiseks ja teenuse pakkumise tagamiseks. Praegu kehtiv kord näeb ette, et perearstid tegutsevad nimistu alusel. Seda üldpõhimõtet ei ole kavas muuta, kuid seadusesse lisatakse säte, mis lubab selgelt teatud juhtudel teenust ka paindlikumalt nimistuvälistele isikutele osutada. Kuigi ka tervisekeskustes kehtib põhimõte, et inimesel on oma perearst ja abi osutatakse nimistupõhiselt, leidub tegevusi, milles võiks ülesandeid jagada. Üheks näiteks on teise nimistu erakorraliste patsientide vastuvõtmine. Eelnõu kohaselt tuuakse seadusesse tervisekeskuse mõiste. Tervisekeskuses pakutakse lisaks perearstiabile teisi esmatasandi teenuseid: vähemalt füsioteraapia, õendusabi ja ämmaemandusabi. Seni on tervisekeskuse mõiste olnud õiguslikult olemas ainult määruse tasandil. Seadusesse toomine loob eelduse, et tervisekeskused kannaks suuremat piirkondlikku vastutust esmatasandi teenuste kättesaadavuse tagamisel. Tervishoiuteenuste korraldamise seaduse muudatused on kavandatud jõustuma käesoleva aasta 1. juulil. Perearstiabi puudutavad muudatused on ette valmistatud koostöös Tervisekassa ja Eesti Perearstide Seltsiga. Muudatused mõjutavad inimesi, kes kuuluvad nimistutesse, millele kvaliteetse arstiabi tagamiseks on täiendav paindlikkus vajalik, ning esmatasandil töötavaid spetsialiste. Muudatusega kaasnevad kulud kaetakse vajaduse korral Tervisekassa eelarvest Ravimiseaduse muudatusega luuakse täiendav võimalus anda luba müügiloata ravimi turustamiseks kindla diagnoosi puhul, et tagada ravimi katkematu kättesaadavus Eestis. Juhtudel, kui ravimiga katkematu varustatuse tagamine on oluline inimeste või loomade tervise seisukohast ning kui teisi sama toimeaine ja tugevusega ravimeid Eestis ei turustata või turustatakse ebapiisavas koguses, võib Ravimiamet lubada alternatiivse müügiloata ravimi turustamist. Seni on müügiloata ravimi turustamiseks olnud vajalik arstide erialaorganisatsiooni taotlus. Sätte eesmärk on kiirendada raviminappuse korral ravimi jõudmist tervishoidu, jääb ära taotluse esitamisele ja läbivaatamisele kuluv aeg, samuti vähendatakse erialaorganisatsioonide koormust taotluse esitamiseks teada olevate müügiloata ravimite turustamiseks lubamisel. Riigilõivuseaduses nähakse ette iseseisvalt teenust osutama asuvate füsioterapeutide, logopeedide ja psühholoogilise ravi osutajate tegevusloa taotlemise riigilõivud. Alates 2023. aasta 1. oktoobrist on neid teenuseid võimalik iseseisvalt osutada ning selle eelduseks on tegevusloa olemasolu. Samuti sätestatakse riigilõivud tubakatoote koostise teate läbivaatamise eest ja teate kehtivuse tagamiseks. Tubakatoodetega seotud riigilõivude kehtestamisel lähtutakse tootja või importija poolt toote koostisosade ja koguste kohta teadete esitamise kontrolli ja hindamise vajadusest. Tubakatoodetega seotud riigilõive puudutavad sätted on kavandatud jõustuma 2025. aasta 1. jaanuaril.” Riigilõivuseaduse muudatused mõjutavad ühekordselt tegevusluba taotlevaid spetsialiste. Tubakatoodetega seotud riigilõivude muudatused mõjutavad tubakatootjaid ja maaletoojaid. Osapooled on eelnõuga tutvunud ja edastanud tagasiside, millega on osaliselt arvestatud. Juhtivkomisjoniks määrati sotsiaalkomisjon.
