Summary
Eelnõuga võetakse Eesti õigusesse üle ELi nn digitaalse sisu direktiiv ja uus tarbijale müügi direktiiv. Direktiivide ülevõtmistähtaeg on 1. juuli 2021. Samuti võetakse üle tarbijaõiguste moderniseerimise direktiiv. Seadustesse tehtavad muudatused puudutavad peamiselt tarkvara, nutitelefoni rakenduste, arvutimängude ja muu digitaalse sisu ostmist, mille puhul on tarbija õigused edaspidi rohkem kaitstud. Digitaalseks sisuks on näiteks ka e-raamatud, video- ja muusikafailid ja teenuseks voogedastusteenused, pilvelahendused jne. Edaspidi käsitletakse sisu või teenuse eest raha maksmisega võrdväärsena ka olukorda, kus tarbija esitab ettevõtjale enda isikuandmeid. Tarbijale antakse sellistes olukordades lepinguõiguslik kaitse ja pannakse ettevõtjale vastutus, kui digitaalsel sisul on mingi puudus. Samuti täpsustatakse juba olemasolevaid reegleid, seoses digitaalsete elementide laialdase kasutamisega erinevates seadmetes. Edaspidi on selgem, millised kohustused ja millise aja jooksul on müüjal näiteks nutitelefoni või fitness käevõru digitaalse elemendi osas. Näiteks ostes poest nutika spordikella, on tarbija ootuseks, et tal on võimalik sellega kasutada erinevaid treeningrežiime, ühildada seda teiste seadmetega jne. Eelnõu kohaselt vastutab müüja ka kella digitaalse elemendi puuduste eest ning seda ka juhul kui digitaalset sisu või teenust pakub tarbijale kolmas isik, näiteks Apple. Ettevõtjate jaoks on oluline, et kaotatakse mitmed lepinguõiguslikud tõkked ja ühtlustatakse õigusraamistikud, mis seni on takistanud piiriülest kaubandust. Kehtivas õiguses ei ole sellisel kujul digitaalset sisu ega digitaalseid teenuseid reguleeritud. Digitaalse sisu direktiiviga täidetakse see lünk ELi õiguses ja tagatakse tarbijakaitse ka selles uudses valdkonnas.
