Summary
Eelnõuga võetakse üle ELi direktiivid, mis käsitlevad sõidukite tehnoülevaatust ja liiklusjärelevalve käigus tehtavat sõidukite tehnokontrolli. Direktiivi ülevõtmise tähtaeg on 20. mai 2017. Eelnõu kohaselt võib edaspidi 30-60 päeva jooksul liikluses kasutada sõidukeid, millel on tehnoülevaatusel või liiklusjärelevalve käigus avastatud puuduseid, mis pole ohtlikud. Kehtiva seaduse kohaselt tohib sellise sõidukiga sõita ainult remondikohta, tehnonõuetele vastavuse kontrolli või tagasi parkimiskohta. Eelnõuga loobutakse Eesti väikesaartel kasutatavate sõidukite tehnoülevaatuse kohustusest. Hiiumaal, Muhus ja Saaremaal on tehnoülevaatus jätkuvalt kohustuslik. Kehtiva seaduse kohaselt peavad kõik liikluses kasutatavad sõidukid olenemata sellest, kus sõidukit kasutatakse, läbima ülevaatuse. Samas ei ole otstarbekas viia kontrolle läbi üksnes väikesaartel kasutatavatel sõidukitel, kus masina kasutusintensiivsus ning liiklustihedus on väga madal. Eelnõu näeb ette tuua tehnoülevaatuse eest võetava tasu piirmäära kehtestamine seadusest ministri määrusesse. Piirmäära kehtestamisel tuleb arvestada, et tehnonõuetele vastavuse kontrolliga tegelev äriühing suudaks katta osutatava teenusega seotud otsekulud, kapitalikulu ja proportsionaalse osa üldkuludest ning teeniks mõistlikku ärikasumit.
