Summary
Eelnõuga tagatakse lihtne, kiire, odav ning tõhus kohtuväline töövaidluse lahendamine. Kohtuväliseid töövaidlusi on seni lahendatud 1996. aasta septembrist kehtiva individuaalse töövaidluse lahendamise seaduse alusel, mille rakendamisel on praktikas ilmnenud mitmeid puudusi. Eelnõu näeb ette alternatiivsed töövaidluse lahendamise võimalused kirjaliku menetluse, lepitusmenetluse ja kompromissi näol. Kehtiv kord võimaldab avalduse läbivaatamist töövaidluskomisjoni (TVK) istungil, erandina võib avalduse lahendada poolte kohalolekuta vaid juhul, kui pooled üksteise nõudeid täies ulatuses tunnistavad. Lepitusmenetluse ning kompromissi võimalused töövaidluse lahendamisel puuduvad. Praktikas kompromissi sõlmimine küll toimub, kuid väljaspool töövaidlust, mille tulemusena ei ole tagatud täitedokumendi olemasolu. Eelnõu kohaselt saab töövaidluskomisjoni juhataja edaspidi ainuisikuliselt lahendada kuni 6400 euro suuruseid rahalisi nõudeid. Muudel juhtudel või poolte soovil, toimub asja lahendamine istungil kolmeliikmelise komisjoniga. Seadusest kaob senine TVK-sse pöördumise rahalise nõude 10 000 euro suurune piirmäär. Praegu saab 10 000 eurot ületava nõudega pöörduda üksnes kohtusse. Töövaidlusasja läbivaatamise tähtaeg pikeneb seniselt 30-lt kalendripäevalt 45-le. Muudatus tuleneb praktikast, kuna viimasel kahel aastal on keskmiseks töövaidluste läbivaatamise pikkuseks 36 päeva. Näiteks mõjutab töövaidluste läbivaatamise aega väljasõiduistungite korraldamine.
