Summary

The purpose of the proposed amendments to the Act on Security Activities (hereinafter: TurvaTS) is to resolve the practical bottlenecks that appeared in the Act before the Act entered into force on July 1, 2024. According to the amendment of § 1 point 1 of the draft, the word "security" in point 1 of § 9 subsection 1 of TurvaTS is replaced by the words "protecting and keeping order", and in points 2 and 3 the words "guarding and protecting" are replaced by the word "security". Section 1 point 2 of the bill is changed to TurvaTS § 10 subsection 1 point 7 and the time during which the security company is obliged to keep the recording of the technical means used in guarding and protecting the security object and maintaining order is reduced from six months to one month starting from the day of recording. Pursuant to § 1 point 3 of the bill, the addition of § 10 subsection 1 of TurvaTS with point 71 enables the circumstances of the offense to be revealed later in cooperation with investigative authorities in relation to the act with the characteristics of the offense detected during the processing of the recordings of technical means explain and carry out criminal proceedings. In essence, the obligation is imposed on the security company to preserve those recordings that contain signs of a crime. This is precisely for the purpose of carrying out criminal proceedings, because the recording may turn out to be an important piece of evidence, the preservation of which is necessary for the state. Pursuant to § 1 point 4 of the bill, TurvaTS § 15 subsection 11 is amended, adding the obligation for the security officer to complete the training necessary for his work in addition to further training (security guard training, security guard training, security manager training).
