Summary

The draft adopts the corresponding EU directive for establishing minimum requirements for joint environmental impact assessment (EIA) for ensuring the protection of the environment and human health. The bill specifies the requirements for the preliminary environmental impact assessment and the content of the report, which makes the preliminary assessments more meaningful and of higher quality. When issuing activity permits, decision-makers must also assess the relevance of the environmental impact assessment report. The explanatory note states that, for example, there may be situations where the application for an activity permit is issued only years after the environmental impact assessment has been recognized as meeting the requirements. However, the corresponding environmental information has changed considerably in the meantime. For this reason, the decision-maker will have to consider each time whether the previously prepared EIA is appropriate or not. In justified cases, the decision-maker has the right to request an additional expert assessment from the developer - thereby ensuring a decision based on up-to-date and adequate material decision making. In addition, it becomes the responsibility of the decision-makers to take into account and include in the conditions of the operating permit the environmental measures prescribed during the EIA. The bill changes the minimum deadline for public display of the environmental impact assessment report. Instead of the current 21 days, there will be 30 days in the future. Although already in the current practice of impact assessment, the website address is generally included in the EIA program and report disclosure notice, where these documents are available electronically. However, this may not always be the case, which is why the law adds a requirement to indicate the corresponding website address in the EIA report disclosure notice. In order to better inform the participants in the proceedings and the public, the decision to recognize the EIA report as meeting the requirements must also include the final conclusions of the report. This helps to better link the report with the granting or non-granting of the license.
