Summary
Eelnõuga võetakse üle ELi vastav direktiiv keskkonna ja inimeste tervisekaitse tagamise ühiste keskkonnamõju hindamise (KMH) miinimumnõuete kehtestamiseks. Eelnõu täpsustab keskkonnamõju eelhindamise ning aruande sisunõudeid, mis muudab eelhinnangud sisukamaks ja kvaliteetsemaks. Tegevuslubade väljaandmisel peavad otsustajad hakkama hindama ka keskkonnamõju hindamise aruande asjakohasust. Seletuskirjas märgitakse, et näiteks võib esineda olukordi, kus tegevusloa taotlus väljastatakse alles aastaid pärast keskkonnamõju hindamise nõuetele vastavaks tunnistamist. Vastav keskkonnaalane teave on aga vahepeal märgatavalt muutunud. Selletõttu peab edaspidi otsustaja iga kord kaaluma, kas varem koostatud KMH on asjakohane või mitte. Põhjendatud juhul on otsustajal õigus nõuda arendajalt täiendavat eksperdihinnangut – seeläbi tagatakse ajakohasele ja adekvaatsele materjalile tuginev otsuste tegemine. Täiendavalt muutub otsustajatele kohustuseks arvestada ja tegevusloa tingimustesse sisse kanda KMH käigus ette nähtud keskkonnameetmed. Eelnõuga muudetakse keskkonnamõju hindamise aruande avaliku väljapaneku miinimumtähtaega. Praeguse 21 päeva asemel on edaspidi selleks aega 30 päeva. Kuigi juba käesoleval ajal mõju hindamise praktikas lisatakse üldjuhul KMH programmi ja aruande avalikustamise teatesse ka veebilehe aadress, kus need dokumendid on elektrooniliselt kättesaadavad. Kuid see ei pruugi alati olla nii, mistõttu lisatakse seadusesse nõue näidata KMH aruande avalikustamise teates ka vastav kodulehe aadress. Menetlusosaliste ja avalikkuse paremaks teavitamiseks peab KMH aruande nõuetele vastavaks tunnistamise otsuses olema muu hulgas välja toodud ka aruande lõppjäreldused. See aitab omavahel paremini siduda aruannet tegevusloa andmise või andmata jätmisega.
