Summary
Eelnõuga kehtestatakse veoauto teekasutustasu. Veoauto teekasutustasu raamistik on kehtestatud ELi vastava direktiiviga raskete kaubaveokite maksustamise kohta teatava infrastruktuuri kasutamise eest, mis võetakse vajalikus osas käesoleva seadusega üle. Teekasutustasu tasumäär sõltub veoauto ja selle haagise täismassist, EURO-heitgaasiklassist ja telgede arvust. Päevane teekasutustasu määr jääb vahemikku 9–12 eurot ning aastane teekasutustasu määr vahemikku 500–1300 eurot. Lisaks on võimalik teekasutustasu tasuda nädala, kuu või kvartali eest. Teekasutustasudest laekuvate tulude sihtotstarbeks on määratud transporditaristu hoid. Ajapõhine teekasutustasu tähendab, et kindlaks määratud summa tasumine annab isikule õiguse kasutada sõidukiga kindla ajavahemiku jooksul kindlaks määratud taristut. Veoautode teekasutustasu kehtestatakse avalikult kasutatavate teede kasutamise eest üle 3500 kilogrammise täismassiga veoauto ja selle haagisega. Teekasutustasust on vabastatud Kaitseväe, Kaitseliidu, välisriigi relvajõudude, Politsei- ja Piirivalveameti ja päästeasutuse sõidukid ning vanasõidukid liiklusseaduse § 83 tähenduses. Seletuskirjas märgitakse, et Eesti ja Soome on ainukesed Euroopa Liidu liikmesriigid, kes ei ole kehtestanud veoautodele teekasutustasu. Euroopa Liidus on kasutusel ajapõhised ja läbisõidupõhised teekasutustasud. Eestis kehtestatakse tulenevalt Riigikantselei poolt 2015. aastal tellitud uuringus „Transpordimaksude rakendamise võimalused Eestis“ analüüsitud alternatiividest veoauto ajapõhine teekasutustasu, kuna selle eeliseks on madalam investeeringu ja hoolduskulu ning sarnane süsteem Lätis ja Leedus rakendatavaga. Teekasutustasu administreerimisega hakkavad tegelema Maanteeamet ja Maksu- ja Tolliamet. Maanteeameti ülesandeks on tagada teekasutustasu tasumise võimalus ööpäev läbi ning seadusega antakse Maanteeametile õigus sõlmida teekasutustasu tasumise võimaluste loomiseks ja tasumise võimaluste korraldamiseks haldusleping eraõigusliku juriidilise isikuga. Kasutusele võetakse ka teekasutustasu tasumise võimalused internetis. Riikliku järelevalvet veoauto teekasutustasu tasumise üle hakkavad teostama Politsei- ja Piirivalveamet ja Maksu- ja Tolliamet oma muude ülesannete täitmise raames. Samuti antakse riikliku järelevalve teostamise õigus Maanteeametile. Juhtivkomisjoniks määrati majanduskomisjon.
