Summary
Muudatustega kõrvaldatakse õiguslik vaakum restitutsiooninõuete menetlemisel ja lõpetatakse vara tagastamise ja kompenseerimise toimingud valdavas osas enne haldusreformiga seonduvaid struktuurimuudatusi. Möödunud aastal lõppesid Eesti Vabariigi omandireformi aluste seaduses (edaspidi ORAS) sätestatud tähtajad õigusvastaselt võõrandatud vara tagastamise toimingute lõpule viimiseks ja kompensatsiooni määramiseks, ent aasta lõpuks jäid siiski rahuldamata ligikaudu 400 isiku restitutsiooninõuded, millest pooltel juhtudel ei saa kohalikud omavalitsused nõuete edasiseks menetlemiseks seada uusi tähtaegu. Eelnõuga kavandatakse abinõud õigusvastaselt võõrandatud vara tagastamise ja kompenseerimise protsessi jätkamiseks ja kiireks lõpetamiseks. Eelnõu kohaselt saavad kohalikud omavalitsused täiendava volituse jätkata ka nende nõuete menetlemist, mida ei olnud võimalik õigustatud isikutest mitte olenevail põhjustel lõpule viia kehtivateks tähtpäevadeks.
