Summary
Eelnõuga kõrvaldatakse kaitselennundusega seotud õigusmaastiku puudused, et tagada kaitseministri määruse „Kaitselennundusmäärustik“ ja kaitseministri määruse „Lubade ja sertifikaatide andmise ning teiste asutuste ja organisatsioonide välja antud lubade või sertifikaatide tunnustamise kord“ õiguspärasus. Seaduse kiireloomulise muutmise on tinginud vajadus uue õppeaasta alguseks tagada võimalus Kaitseväe Akadeemia (KVA) ja Eesti Lennuakadeemia (ELA) koostöö tegemise võimalus. Kaitseväe Akadeemia alustas veebruaris 2024 dokumentide vastuvõttu õhuväe õppesuunal spetsialiseerumiseks õhusõiduki juhi erialale, muu hulgas nägi plaan ette piloodi algõppe andmist koostöös Lennuakadeemiaga. Õppekavas esitleti ekslikult, et õhusõiduki juhtimise eriala lõpetanutele väljastab piloodiloa Transpordiamet. Kuid Transpordiamet saab väljastada vaid tsiviillennunduses piloodilubasid, riiklike õhusõidukite osas Transpordiametil pädevust ei ole ning selline tegevus ei ole lubatud. Eelnõuga kõrvaldatakse need vastuolud kõrvaldatakse ning tagatakse, et kaitseministri määrustes sätestatud regulatsioone ning nende alusel tehtavaid toiminguid on võimalik õiguspäraselt rakendada. Kaitselennundusmäärustikus on volitusnormi puudumise või ületamisega reguleeritud mitmeid valdkondi. Eelnõus sätestatakse selge volitusnorm kaitseministrile neid oma määrusega reguleerida. Need valdkonnad on: kaitselennunduse õhusõidukite jagunemine; nõuded kaitselennunduse õhusõiduki lennukõlblikkusele ja jätkuvale lennukõlblikkusele; operatiivse lennuliikluse lennureeglid; kaitselennunduse järelevalve korraldamise kord. Selleks antakse lennundusseadusega otsustamispädevuse õigus kliimaministrile. Pärast seda on võimalik kliimaministril võimalik see õigus anda Lennuakadeemiale.
