Summary
Eelnõuga täiendatakse looduskaitseseadust, et rakendada Nagoya protokolli geneetiliste ressursside juurdepääsu ja nende kasutamisest saadava tulu õiglast jaotamist. Tulenevalt Nagoya protokollist on määruse eesmärk tagada, et ELis kasutatavad geneetilised ressursid ja nendega seotud traditsioonilised teadmised oleks omandatud päritoluriigist õiguspäraselt. Eestis otsekohalduv vastav Euroopa Parlamendi ja Nõukogu määrus paneb liikmesriikidele kohustuse luua järelevalvesüsteem riigis kasutatavate geneetiliste ressursside ja nendega seotud traditsiooniliste teadmiste kasutajate, kes täidavad määrusest tulenevaid kohustusi, kontrollimiseks. Määrusest tulenevate nõuete rikkumisel kehtestatakse karistused. Eelnõus nimetatakse määruse täitmise eest vastutavate pädevate asutusteks keskkonnaministeerium, maaeluministeerium ning haridus- ja teadusministeerium. Nagoya protokollis käsitletakse geneetilise materjalina taimse, loomse, mikroobse või muu päritoluga materjali. Nende kasutamise all peetakse silmas geneetilise ja/või biokeemilise koostise alast teadus-ja arendustegevust.
