Summary
Eelnõuga ratifitseeritakse Euroopa Liidu ning Ladina-Ameerika ja Kariibi piirkonna rahvusvahelise sihtasutuse asutamisleping, millele Eesti kirjutas alla 25. oktoobril 2016. 2011. aastal asutati Hamburgis ELi ning Ladina-Ameerika ja Kariibi piirkonna (edaspidi CELAC) fond, mille eesmärgiks oli tugevdada ELi ja CELACi liikmesriikide partnerlust ning soodustada piirkondadevahelist vastastikust mõistmist ja nähtavust. Fond asutati eeldusel, et see muudetakse võimaluse korral edaspidi sõlmitava rahvusvahelise asutamislepinguga rahvusvaheliseks organisatsiooniks. Lepingu eesmärk on asutada ELi ning Ladina-Ameerika ja Kariibi piirkonna sihtasutus rahvusvahelise organisatsioonina, millel on rahvusvahelise avaliku õiguse kohaselt juriidilise isiku staatus. Sihtasutust võib vaadelda kui ELi ühise välispoliitika vahendit, sest selle tegevus aitab lähendada liikmesriikide tegevust Ladina-Ameerika ja Kariibi piirkonna suunal, tagades, et EL on suuteline panema kahe piirkonna partnerluse raames maksma oma huvid ja väärtused. Sihtasutuse asutamine rahvusvahelise organisatsioonina aitab suurendada selle suutlikkust koguda oma liikmesriikidelt rahalisi vahendeid – paljud liikmesriigid ei saa praegu sihtasutuse vabatahtlikku rahalist panust anda, sest fond on asutatud Saksa tsiviilõiguse alusel. Kui fond saab rahvusvahelise organisatsiooni staatuse, võimaldab see tal kärpida ka teatavaid kulusid, saada kasu rahvusvahelisest õigusest tulenevatest privileegidest ja immuniteetidest ning kasutada paremini ära oma rahalisi vahendeid ja inimressursse. See omakorda võimaldab säilitada ja arendada edasi tegevust partnerluse toetamiseks. Juhtivkomisjoniks määrati väliskomisjon.
