Summary
Eelnõuga ratifitseeritakse Euroopa Liidu ja Kanada vaheline majandus- ja kaubandusleping (CETA), millele Eesti kirjutas alla 28. oktoobril 2016. CETA puhul on tegemist majanduslikus mõttes Euroopa Liidule tervikuna olulise ja seni kõige ambitsioonikama lepinguga, mida ELil on õnnestunud kolmanda riigiga läbi rääkida. CETAga saavad Euroopa ettevõtted võimaluse tegutseda samades konkurentsitingimustes nagu Kanada firmad. Näiteks avaneb CETAga esmakordselt välispartneritele Kanada provintside ja kohalike omavalitsuste riigihangete turg. CETA kaotab 99 protsenti tollimaksudest ja seda suures osas alates lepingu ajutisest kohaldamisest. Tööstus-ja kalatoodete ning veinide ja alkoholi osas toimub täielik liberaliseerimine. Tariifid kaotatakse samuti ELile olulistele ekspordiartiklitele nagu maiustused, küpsetised, puu- ja köögiviljad. Kaubanduse elavdamisele peaksid lisaks tariifide alanemisele kaasa aitama veel näiteks lihtsustused päritolureeglites, tehniliste normide vastastikuse tunnustamise lihtsustamine ning sanitaar- ning fütosanitaarreeglite protsesside sujuvamaks muutumine. Lisaks avanevad Euroopa ettevõtjatele CETA kaudu uued võimalused Kanada teenuste turul. Liberaliseerimine puudutab energia, finantsteenuste, telekommunikatsiooni ja mereveo teenuste sektoreid. Lepinguga lihtsustub näiteks ka ettevõttesiseselt ajutiselt üleviidud spetsialistide ja juhtivtöötajate liikumine Euroopa Liidu ja Kanada vahel. Eestil pole Kanadaga kehtivat investeeringute soodustamise ja kaitse lepingut. CETAs sisaldub ELi uus läbipaistvam ja institutsionaliseeritud lähenemisviis investeeringute kaitsele ja ka nendega seotud vaidlustele. Kõnealune leping on investeeringute osas – võrreldes Eesti tänaseni sõlmitud investeeringute kaitse kahepoolsete lepingutega – oluliselt õiguskindlam. Lepingus käsitletakse sundvõõrandamise tingimusi ja õigust pöörduda kohtusse. Seega tuleb see ratifitseerida Riigikogus, sest leping ise sisaldab selliseid üksikisikutele otsekohaldatavaid õigusi ja kohustusi, mida põhiseaduse kohaselt saab sätestada ainult seadusega. Nimelt saavad lepinguosaliste kodanikud otse CETA alusel lepinguosalise riigi (k.a Eesti) vastu investeeringute peatüki sätete kohaselt nõudeid esitada. Juhtivkomisjoniks määrati väliskomisjon.
