Summary

The bill updates the Blood Act and transfers the organization of the reference service for immunohematological studies from the Ministry of Social Affairs to the Health Board. This increases the competence of the Health Board in the field of blood and helps ensure the quality of blood tests. Currently, the Health Board provides reference laboratory services in health protection and does so, for example, in the case of infectious diseases and drinking water research. The reference laboratory for immunohematological studies provides a service which during the process, for example, donor blood preparations suitable for the patient's treatment are determined. The purpose of the reference laboratory is to ensure the quality of immunohematological research in Estonia. Immunohematological studies are used to determine the blood group and blood composition, including to assess the compatibility of donor and patient blood before blood transfusions. In addition, according to the draft, the requirement of a five-year contract for the provision of reference services will be removed from the law. It is necessary to allow flexibility and give the health board discretion over the term of the contract. The terms of the contract must be based on the rules set out in the Public Procurement Act: for example, the contract could be up to 48 months in length, the conclusion of a longer contract must be justified. According to the procurement contract, the reference service of the reference laboratory for immunohematological studies is currently provided by SA Northern Estonian Regional Hospital until 2027. The transfer of the task from the Ministry of Social Affairs to the Health Board does not affect the validity of this contract. This means that the content and quality of blood services for the patient, PERH and healthcare providers will not change. The reference service provider is paid a maximum of 143,736 euros annually based on the current management contract. The organization of public procurement and other service-related activities for the organization of the reference service do not require a separate position and do not entail additional costs.
