Summary
Eelnõuga ajakohastatakse vereseadust ja viiakse immunohematoloogiliste uuringute referentteenuse korraldamine sotsiaalministeeriumist terviseametisse. See suurendab terviseameti kompetentsi verevaldkonnas ja aitab tagada vereanalüüside kvaliteeti. Praegu osutab terviseamet referentlabori teenuseid tervisekaitses ja teeb seda näiteks nakkushaiguste ja joogiveeuuringute puhul. Immunohematoloogiliste uuringute referentlabor osutab teenust, mille käigus määratakse näiteks kindlaks patsiendi raviks sobivad doonoriverepreparaadid. Referentlabori eesmärk on tagada immunohematoloogiliste uuringute kvaliteet Eestis. Immunohematoloogilisi uuringuid kasutatakse veregrupi ja vere koostise määramiseks, sealhulgas doonori ja patsiendi vere sobivuse hindamiseks enne vereülekandeid. Lisaks kaotatakse eelnõu kohaselt seadusest referentteenuse osutamise lepingu viieaastase kestvuse nõue. See on vajalik, et võimaldada paindlikkust ja anda terviseametile kaalutlusõigus lepingu tähtaja suhtes. Lepingu tähtaegade osas tuleb lähtuda riigihanke seaduses toodud reeglitest: näiteks leping võiks olla pikkusega kuni 48 kuud, sellest pikema lepingu sõlmimine peab olema põhjendatud. Hankelepingu järgi osutab praegu kuni 2027. aastani immunohematoloogiliste uuringute referentlabori referentteenust SA Põhja-Eesti Regionaalhaigla. Sotsiaalministeeriumilt terviseametile ülesande üleandmine ei mõjuta selle lepingu kehtivust. See tähendab, et patsiendi, PERH-i ja tervishoiuteenuse osutajate jaoks vereteenuste sisu ega kvaliteet ei muutu. Referentteenuse osutajale makstakse kehtiva halduslepingu alusel igal aastal maksimaalselt 143 736 eurot. Referentteenuse korraldamiseks riigihanke korraldamine ja muud teenusega seotud tegevused ei vaja eraldi ametikohta ega too kaasa täiendavaid kulusid.
